After police escalated a chase, he stopped and fired several shots at police. Numerous officers arrived and he sat in his vehicle until police shot and killed him.

Chaves County deputies Joshua McKelveyvand Benjamin Conklin were called to a local dairy farm because David Aguilera was reportedly disorderly and tried to drive a tractor at work when someone called police. Police arrived and tasered him multiple times. He tried to escape the attack by driving away in a police vehicle. Officers Conklin and McKelvey shot and killed the unarmed man.Aguilera was polite, even apologetic toward the officers, and obviously confused, asking why he was being handcuffed. The deputy said he did not know what he had done to be arrested and he cursed Aguilera and tased him in response. It is unclear what escalated the situation because the bodycams of all 3 deputies stopped working at the same time when he was put in the cruiser and the video resumed later just prior to his killing. Officer McKelvey claimed that Aguilera picked up a pipe or tire iron but the other officers did not report this and the video evidence of what happened after he was put in the patrol car is inexplicably missing from all 3 deputies’ bodycams. Aguilera was reported by his family to be a dedicated family man with 6 children, 4 of whom were stepchildren whom he provided for and was reportedly a great parent to. After the killing, local media asked for Deputy Conklin to be indicted for his role in the avoidable death. Conklin had also previously shot and killed 65-year-old Craig Heinzen on July 16, 2021. After the Heintzen shooting, Conklin was struggling with mental health and alcoholism, spent 35 days as an inpatient in substance rehab and was at work mere weeks again when he killed Aguilera. The DA passed on the case and turned it over to the AG who reviewed it but did not indict the deputies.

Torrance County deputies were sent to a call about a car stuck in snow. They allege that they questioned the driver. It is unclear why. They further allege that he pulled a gun and pointed it. A man called 911 to say that he had spotted his neighbor’s stolen truck and there was a man inside passed out. Police began to gather but the truck drove off and a helicopter followed it. The driver drove the wrong way in traffic and turned on to a street next to the Court John Motel.
The male tried to get onto a motorcycle. A foot chase started and he allegedly pulled a firearm out of his pocket. Police shot and killed him.

On December 13, 2021, at approximately 9:00 a.m., deputies from the Torrance County Sheriff's Office responded to a report of shots fired at a residence on West Alan Ayers Road in Estancia. A caller reported that a male, wearing a black hoodie and a red facemask, entered her backyard and fired at least one shot before fleeing westbound on West Alan Ayers Road. A deputy located the man near West Alan Ayers Road and Lassiter Road. For reasons still under investigation, the deputy discharged his duty weapon at least once, striking the man. Despite administering first aid, the man was pronounced dead at the scene by the Office of the Medical Investigator. The New Mexico State Police Investigations Bureau is leading the investigation into the incident.

On December 7, 2021, at approximately 9:00 p.m., deputies from the Bernalillo County Sheriff's Office responded to a domestic violence call at the Las Mañanitas apartment complex near Coors and Montaño in Albuquerque. The victim had previously reported a domestic violence incident at an Allsup's gas station earlier in the day. Upon arrival, deputies arrested Mario Armando Diaz, 41, at the apartment complex. While being transported in a patrol vehicle, Diaz managed to slip one hand out of his handcuffs and attempted to flee. A brief foot pursuit ensued, leading to a physical altercation between Diaz and Deputy Taylor Feist. During the struggle, Deputy Feist called out that Diaz had her gun. In response, Deputy Dereck Gallegos fired two shots, fatally wounding Diaz. The incident was captured on body-worn cameras and a street camera.

On November 26, 2021, at approximately 2:00 p.m., deputies from the Bernalillo County Sheriff's Office responded to a report of a hit-and-run crash at the intersection of Edith Blvd NE and Montano Rd NW in North Valley, Albuquerque. Deputy Ronald Perez, a 10-year veteran of the department, was among the responding officers. The man, identified as 18-year-old Elijah Richie, fled the scene on foot after crashing his red SUV into a chain-link fence at Edith Blvd and Nikanda Road. Surveillance footage showed Richie attempting to flee the scene, armed with an AR-15 style pistol and carrying a backpack containing additional firearms. Deputy Perez pursued Richie and, after verbal commands to drop the weapon, fired a single shot, fatally wounding Richie. Richie was pronounced dead at a local hospital shortly after the incident. The shooting was captured on body-worn cameras and surveillance footage. The incident is under investigation by the Multi-Agency Task Force, a collaborative team that investigates officer-involved shootings.

On November 26, 2021, at approximately 2:30 p.m., a New Mexico State Police officer arrived at a Starbucks on Promenade Boulevard in Santa Fe and was informed by employees that the store had just been robbed by a man and a woman with firearms. They fled in a black Kia without a license plate. A pursuit ensued, with them traveling south on Richards Avenue, then north on Interstate 25, and subsequently south on U.S. 285. During the chase, the female passenger, identified as Christean "Christy" Ann Dimas, fired shots at officers. Officers from the New Mexico State Police, Santa Fe County Sheriff's Office, and Torrance County Sheriff's Office returned fire. The vehicle crashed near Clines Corners, and the driver, Jacob Montoya, was apprehended. Dimas was found deceased in the passenger seat. Montoya was airlifted to a nearby trauma center for gunshot wounds and later booked into the Torrance County Detention Facility on multiple charges, including assaulting a peace officer and shooting from a motor vehicle.

On November 9, 2021, at approximately 7:00 a.m., an off-duty Las Cruces Police Department (LCPD) officer conducted a welfare check on a single-car crash on I-25 north. The driver, identified as 28-year-old Dagoberto Jimenez, exited the vehicle, threatened the officer with a knife, and carjacked the officer's personal vehicle. The officer reported the incident, and LCPD officers located Jimenez near the intersection of Amador Ave. and Solano Drive. Jimenez fled the scene, driving off the road near S. Esperanza St. and Amador Ave., crashing through a fence, and entering the Mesilla Valley Leadership Academy property. SWAT and negotiators were called in to make contact with Jimenez. During the standoff, a single gunshot was heard, and Jimenez was found deceased from a self-inflicted gunshot wound. The investigation was conducted by the Las Cruces Police Department.

Upon arrival, deputies encountered an 85-year-old male who was suicidal and armed with a firearm. After approximately nine minutes, the individual fatally shot himself. On October 9, 2021, at approximately 8:00 p.m., officers from the Las Cruces Police Department initiated a traffic stop near the intersection of 5th Street and Wilson Avenue. During the stop, the driver, identified as 35-year-old Gustavo Angel Esparza, opened fire on the officers before fleeing the scene. A brief pursuit ensued, ending at 4th Street and Davis Avenue, where Esparza barricaded himself inside his vehicle. On 09/13/2021, deputies with the San Juan County Sheriff’s Office were serving a search warrant at a residence on County Road 3935 in Farmington, New Mexico. Police stated the warrant was related to an alleged assault reported earlier that day. Police alleged Tedman Werito threw an object described as a non functioning grenade from the residence. Police stated deputies deployed flashbang devices and tear gas. Police alleged Werito later pointed an object they believed to be a firearm toward deputies. Deputies opened fire and shot and killed Werito. Police later stated the firearm was a replica.

On September 11, 2021, deputies from the Lincoln County Sheriff's Office, along with state police, responded to a domestic violence call along Spring Canyon Road near Ruidoso. Upon arrival, the man fired shots at the officers. After hours of negotiations, deputies heard gunfire from within the residence. Upon entering, they discovered the man deceased from a self-inflicted gunshot wound.

On September 6, 2021, at approximately 9:54 p.m., deputies from the Torrance County Sheriff's Office (TCSO) and officers from the New Mexico State Police (NMSP) responded to a domestic violence call at 23 Short Street in Moriarty, New Mexico. Upon arrival, 46-year-old Cimmeron Christy fired multiple shots at the officers from inside his residence. The officers retreated to a safe distance and called for assistance. The NMSP Crisis Negotiations Team, NMSP Tactical Team, and the Albuquerque Police Department (APD) SWAT Team responded to the scene. Negotiations were attempted, but Christy continued to fire shots toward the officers. An APD SWAT officer returned fire, fatally wounding Christy. He was pronounced deceased at the scene by the Office of the Medical Investigator. No deputies or officers were injured during the incident. Adam Nickolas Alvarez, 37, was found dead inside a residence at 8904 Corona Road in Las Cruces, New Mexico, following a standoff with police. Alvarez allegedly fired shots at a Dona Ana County deputy. Police opened fire, and after several hours, he was discovered deceased inside the home.

On September 3, 2021, at approximately 3:00 p.m., deputies from the Valencia County Sheriff's Office (VCSO) responded to a suspicious vehicle report on New Mexico State Road 6 near mile marker 19. Upon arrival, they encountered 28-year-old Jose Angel Baca, who fired at a deputy, striking him. Baca then fled the scene in a white Dodge pickup truck. A "be on the lookout" (BOLO) alert was issued, and VCSO deputies, along with New Mexico State Police (NMSP) officers, located Baca's vehicle and initiated a pursuit. The chase continued through Los Lunas, with Baca eventually crashing near the railroad tracks at State Road 314 and Davila Road. Baca exited the vehicle and began firing at law enforcement officers. In response, two VCSO deputies and one NMSP officer discharged their weapons, fatally wounding Baca. A VCSO deputy was injured by shrapnel during the exchange but was treated and released from the hospital. Baca was pronounced deceased at the scene. At the time of the incident, Baca had recently been released from probation for aggravated battery upon a police officer resulting in great bodily harm, battery on a household member, and resisting, evading, or obstructing an officer during arrest. The names of the officers involved were not released immediately following the incident. The New Mexico State Police Investigations Bureau conducted the investigation into the officer-involved shooting.

Nicolas "Nico" Matthew Romero, 18, was killed in a crash at the intersection of NM-68 and NM-518 in Ranchos De Taos, New Mexico. On August 15, 2021, at approximately 5:00 p.m., officers from the Albuquerque Police Department (APD) observed a stolen vehicle occupied by a male and female near Lomas Blvd. and Louisiana Blvd. The vehicle fled from a traffic stop, prompting officers to deploy a StarChase GPS tracking device, which successfully attached to the vehicle. The vehicle was tracked to Morrow Ave. and Pennsylvania Blvd. NE, where officers discovered the tracking device had been removed. The vehicle was later found unoccupied in a Walmart parking lot at Northeastern Blvd. and Wyoming Blvd. NE. Officers located a male and female matching the descriptions of the individuals who had exited the stolen vehicle. During questioning, the male suspect, identified as Eric Padilla, handed over a knife from his pocket but refused to be patted down. As officers insisted on conducting a search, Padilla fled on foot. Witnesses and video footage indicate that as Padilla ran, he turned slightly to his left and produced a handgun. Both officers fired their weapons, striking Padilla, who succumbed to his injuries at the scene. A firearm was recovered near Padilla. The incident is under investigation by the Albuquerque Police Department.

On 08/03/2021, a U.S. Border Patrol agent attempted to stop a northbound vehicle that had evaded a checkpoint on New Mexico State Road 185. The agent and another Border Patrol unit pursued the vehicle with emergency equipment activated. Approximately three miles north of the checkpoint, the vehicle crashed and several occupants were ejected. The driver, Erik A. Molix, later died of his injuries. Another passenger also died from injuries sustained in the crash. Eight other occupants were hospitalized.

On 07/31/2021, Hector Mario Nava Jr. died after a traffic stop and detention by the Jal Police Department in Jal, New Mexico. Police stopped Nava after reporting that he was driving without headlights and alleged he gave false identification. Officers handcuffed Nava and forced him into a caged compartment in a K9 patrol vehicle. Federal prosecutors later alleged officers deployed a Taser repeatedly during the effort to confine him. Nava was then transported to jail. Police records and federal filings described Nava becoming unresponsive during custody, after which he stopped breathing and died. The City of Jal later settled a wrongful death and excessive force claim brought by Nava’s estate. In 2024, federal charges were filed against Jal officers related to the incident, and in 2025, federal reporting described convictions tied to Nava’s death.

On July 17, 2021, at approximately 9:36 p.m., Las Vegas Police Department officers responded to a domestic disturbance at 1308 Keen Street in Las Vegas, New Mexico. Upon arrival, officers attempted to make contact with the reporting party. During this time, Jeffery Scott, 30, exited a nearby residence with a firearm. Scott allegedly fired multiple rounds. Two LVPD officers opened fire, killing Scott.

On 06/08/2021, at approximately 9:30 p.m., Española police officers responded to a welfare check involving a vehicle parked at Ranchitos Park near North Riverside Drive and CII Ranchitos. Officers made contact with a man and a woman outside the vehicle. The man, identified as Louis Nathan Leyba, entered the driver’s seat while the woman entered the passenger seat. As Officer Derrick Valdez attempted to speak with the woman, Leyba began driving the vehicle in reverse. Officer Valdez became caught between the open door and the vehicle as it moved, and his feet dragged along the pavement. Officer Valdez ordered Leyba to stop. Leyba continued driving. Officer Valdez fired his weapon, and Officer Anthony Martinez also fired. Leyba was struck and died from his injuries. The shooting was placed under investigation. No officers were charged.

On April 16, 2021, Albuquerque Police Department officers responded to a domestic dispute at a residence on Coyote Canyon Place NW in Albuquerque, New Mexico. Juan James Cordova, 51, was reportedly armed and had fired a shot inside the house and was in mental health crisis per his girlfriend. Officers spent approximately an hour attempting to negotiate with Cordova, urging him to surrender peacefully.

Despite negotiations, Cordova remained uncooperative, holding a firearm and making statements suggesting he intended to provoke a lethal response from the police. At one point, he fired a round, which passed through a window and struck a neighbor's house. When Cordova allegedly pointed his firearm at the officers, Officer Bryce Willsey opened fire and killed him.
