OPEN RECORDS SUMMARY :

On 08/27/2024, at approximately 5 p.m., Asheville Police Department officers responded to 107 Chatham Road after several people called 911 concerning Chad Owen Herman, 58, who was reportedly outside his residence with a rifle.

According to Asheville Police Chief Mike Lamb, the incident began with an altercation between Herman and a contractor working for the City of Asheville who was installing water meters in the neighborhood. Police alleged that Herman became angry with the worker, pointed a rifle at him and assaulted him with a shovel. The worker was transported to Mission Hospital and was released later that evening.

Police also said other people in the neighborhood reported that Herman pointed the rifle at them before officers arrived. A search of North Carolina court records conducted by Blue Ridge Public Radio at the time found no criminal history for Herman in the state.

According to police, officers encountered Herman outside the residence and ordered him to put down the rifle. Police alleged that Herman did not comply and pointed the rifle toward officers. At least one Asheville police officer then fired at Herman, striking him.

After being shot, Herman retreated into the Chatham Road residence and barricaded himself inside. Police established a perimeter and brought additional personnel to the scene. Another person was reportedly inside the residence during the barricade.

Police subsequently entered the residence and found Herman dead. Asheville police did not disclose in the initial reporting how many shots the officer fired, and the department said details concerning the gunfire were part of the investigation.

The North Carolina State Bureau of Investigation assumed responsibility for investigating the fatal shooting. Under Asheville Police Department policy, the officer who fired at Herman was placed on investigative leave. The completed SBI investigation was to be forwarded to the Buncombe County District Attorney's Office for review.
