On 08/09/2024, Joseph Fleming, 29, was shot by Palm Bay Police Department officers Thomas Baker and John Neal during an armed domestic disturbance at a residence on Biarritz Street NW. Fleming survived the initial shooting but died at a hospital on 08/14/2024. The database Date field reflects the date of the police shooting rather than the later date of death.

At approximately 9:10 a.m., Palm Bay police received a 911 call reporting a suspicious incident at the residence. Officers arrived approximately three minutes later and heard a gunshot from inside the home. Police subsequently determined that the incident involved domestic violence.

Police alleged that Fleming had shot and killed his 23-year-old sister-in-law, Jaquelynn Wray, inside the residence. Wray was subsequently found dead from a gunshot wound.

According to Palm Bay police, Fleming came out of the residence and fired at responding officers. Officers returned fire, striking Fleming. Fleming then ran through the surrounding neighborhood, and police established a perimeter while searching for him.

The Brevard County Sheriff's Office Aviation Unit located Fleming nearby with gunshot injuries. Police took him into custody, and he was airlifted to a trauma center in critical condition. He remained hospitalized until his death five days after the shooting.

Thomas Baker and John Neal were publicly identified by Palm Bay police as the officers involved in the shooting of Fleming.Thomas Baker had previously participated in the fatal police shooting of William Miles Jr., 38, in Palm Bay on 02/07/2023. Baker was one of four Palm Bay SWAT officers who fired during that encounter. The State Attorney later determined that the officers' use of deadly force was legally justified, after which Palm Bay Police continued its administrative review of the shooting.
