On 08/08/2024, at approximately 12:17 p.m., New Mexico State Police officers and Colfax County Sheriff's Office deputies responded after receiving a 911 report that a man driving a maroon Dodge pickup had forced a Springer Electric Company vehicle off the roadway and pointed a firearm at its occupants. Officers located the pickup on State Road 505 and attempted a traffic stop. The reason for the pursuit was the report that the driver had run another vehicle off the road and threatened its occupants with a firearm.
The driver initially stopped but then reversed into a New Mexico State Police patrol vehicle and drove away, initiating a pursuit. Near the intersection of U.S. Highway 64 and New Mexico Highway 445, a New Mexico State Police officer performed a PIT maneuver. The pickup attempted to continue fleeing but collided head-on with a State Police patrol vehicle, disabling both vehicles. At that point, two Colfax County Sheriff's deputies fired their weapons, striking 42-year-old Tyrel Richter Cutchie. Deputies and officers immediately began lifesaving measures until EMS arrived, but Cutchie was pronounced dead at the scene by the Office of the Medical Investigator. Two New Mexico State Police officers and one Colfax County deputy sustained minor injuries during the incident.
The New Mexico State Police Investigations Bureau conducted the independent investigation. The agency stated it would determine the sequence of events, collect evidence, and interview witnesses before forwarding its findings to the district attorney for review. Public reporting through 2026 located no criminal charges against the deputies, no publicly announced disciplinary action, no publicly reported civil lawsuit or settlement arising from the shooting, and no public release identifying the deputies who fired. Cutchie had been a sovereign citizen.
