OPEN RECORDS SUMMARY :
On 07/25/2023, Terre Haute Police Department officers responded to a business at 1309 Fruitridge Avenue after reports that 34-year-old Christopher W. Fortin had entered the property armed with a handgun, told employees the business now belonged to him, and ordered them to leave. Employees evacuated safely before officers arrived. Fortin retreated into a storage building on the property, leading to a standoff.
Police attempted to negotiate with Fortin for approximately two hours. According to investigators, Fortin eventually emerged from the building while armed with a handgun and pointed it toward officers. Two Terre Haute police officers fired, striking Fortin. He was pronounced dead at the scene.
The Indiana State Police investigated the shooting. On August 1, 2023, Vigo County Prosecutor Terry Modesitt concluded that the officers' use of deadly force was legally justified under Indiana law and declined to file criminal charges.
