OPEN RECORDS SUMMARY :

On June 1, 2025, around 8:10 a.m., Cpl. Damion Allen of the Fulton County Police Department was providing security at the Heritage Station Apartments at 765 McDaniel Street SW in Atlanta. A bystander alerted the officer to someone breaking into his marked patrol vehicle. The person, identified as 51-year-old Elieser Rivera Jr. of Passaic, New Jersey, had allegedly broken the window. When confronted, Rivera was reportedly armed with a piece of flat metal and advanced toward the officer despite repeated commands to drop it. Cpl. Allen opened fire, killing Rivera at the scene. The Georgia Bureau of Investigation is conducting an independent investigation.
