In the early morning hours of July 20, 2025, at approximately 3:15 a.m., Kinston Police Department officers responded to a 911 call reporting a domestic disturbance at a residence on the 1300 block of Manchester Road. The caller reported that a man was armed and threatening to kill everyone in the home. Upon arrival, officers encountered Nathan Thomas Burney, 72, who stood behind a glass door armed with a handgun.
Officers issued repeated commands for Burney to drop the weapon. He refused and continued to point the gun through the glass door. In response, Captain Andrew Willis and Corporal James McDevitt discharged their firearms through the door, striking Burney. He was pronounced dead at the scene. During the incident, officers located a woman hiding in a closet, who appeared unharmed but traumatized.
The North Carolina State Bureau of Investigation has taken over the case. Body camera footage is reportedly part of the ongoing review, though no footage has been publicly released. The community expressed concern over the use of lethal force in the elderly man’s death, raising calls for a thorough and transparent investigation. Both officers involved were placed on administrative leave pending the outcome.
