OPEN RECORDS SUMMARY :
On 07/30/2023, Jackson County Sheriff's deputies responded to a welfare check at a residence in the 3000 block of Robinson Road in Summit Township after receiving information that something had happened to 55-year-old Karen Tobin. Deputies found Tobin dead inside the home from multiple stab wounds and blunt-force injuries. Investigators identified her son, David McClure, as the person of interest after learning he had threatened to kill her and had left the scene in her vehicle.
Shortly before 9:00 p.m., McClure returned to the residence, where numerous patrol vehicles were present. According to investigators, he drove the vehicle into two sheriff's patrol vehicles before getting out armed with a hammer and a knife. Deputies Christopher Davis and Theodore Breijak repeatedly ordered him to drop the weapons. Prosecutors said McClure refused, threw the hammer toward the deputies, and continued advancing while holding the knife. Davis and Breijak fired, striking McClure multiple times. Deputies rendered medical aid before he was transported to Henry Ford Jackson Hospital. He was removed from life support and died on 08/03/2023.
In November 2023, Jackson County Prosecutor Jerard Jarzynka concluded that Deputies Davis and Breijak were legally justified in using deadly force and declined to file criminal charges. The prosecutor determined McClure presented an immediate threat of death or great bodily harm to the deputies. In 2024, the Michigan Association of Police Organizations recognized Davis and Breijak as Jackson County Deputies of the Year for their actions during the incident.
