OPEN RECORDS SUMMARY :

On May 23, 2024, at approximately 11:45 a.m., officers from the Aurora Police Department's SWAT team, in collaboration with the Denver Police Department's fugitive unit, attempted to arrest 37-year-old Kilyn Lewis at the Edenbrook condominiums in Aurora. Lewis was a suspect in a May 5 shooting incident in Denver. As officers approached, Lewis was observed exiting his red Chevrolet Monte Carlo. Body-worn camera footage shows Lewis raising his hands, holding a cellphone, before being shot by Officer Michael Dieck. Lewis fell to the ground, stating, "I don't have nothing," and was transported to a hospital, where he died two days later.

Officer Dieck, a 12-year veteran of the Aurora Police Department, was placed on administrative leave following the incident. The 18th Judicial District Critical Incident Response Team conducted an independent investigation into the shooting. On October 12, 2024, District Attorney John Kellner announced that Officer Dieck would not be prosecuted, stating that he believed Lewis was holding a gun and was about to fire at officers.

The Aurora Police Department released body-worn camera footage to provide transparency. The footage shows officers issuing commands to Lewis, who then raises his hands holding a cellphone before being shot.

Lewis's family and community members have expressed concerns about the use of deadly force in this incident. They have called for further investigation and accountability regarding the actions of Officer Dieck.

Officer Dieck had previously also fatally shot Tyrell Jones in 2018. Officer Dieck was cleared for that shooting.
