Police allege that Daniel Rivera had stolen a car and they were chasing it. Rivera allegedly got out and ran into the woods near Yankee Stadium, fired shots at police and fled. Police caught up with him and executed him with 29 bullets. All family members expressed disbelief at the official police narrative, stating that Rivera did not drive cars and would not be in this situation.
The officer who led the shooting, Michael Menesis, had shot and killed Gambian immigrant Abdou Jallow just the previous year via a stray bullet that hit him when the man was praying in a mosque and Menesis was shooting at someone else nearby.
