SUMMARY
On New Year’s Day, 01/01/2026, at approximately 10:32 p.m., a New York State Police Trooper assigned to the Montgomery Barracks attempted to stop a 2012 Volkswagen for a traffic violation on State Route 17K in the Town of Newburgh. The driver, identified as 39-year-old Marcus Burks of Newburgh, did not comply and fled in his vehicle. After roughly two minutes, the trooper allegedly called off the chase because of unsafe speeds. The Volkswagen collided with another vehicle that was turning from a business driveway. Burks was taken into custody at the scene. While handcuffed and in police custody, he became unresponsive. Emergency responders administered life-saving measures and transported him to Montefiore St. Luke’s Cornwall Hospital, where he later died. The New York State Police were assisted by the City of Newburgh Police Department, and the New York State Attorney General’s Office has been notified. An investigation into the circumstances of his death remains ongoing
