OPEN RECORDS SUMMARY :
On 02/28/2025, officers from the Albuquerque Police Department responded to an apartment in northeast Albuquerque after a supervisor at a local hospital called 911 requesting a welfare check on David McElvain, who had called into work but did not show. Officers opened the apartment door during the welfare check. Within seconds, one officer discharged a duty weapon three times, striking McElvain. McElvain was pronounced dead at the scene. The personal representative of McElvain’s estate subsequently filed a wrongful death lawsuit alleging officers entered without a warrant before opening fire. The lawsuit was filed on 01/13/2026 in the 2nd Judicial District Court.
