OPEN RECORDS SUMMARY :

On 07/07/2026 at approximately 2:26 p.m., Marion County Sheriff's Office deputies responded to the 14900 block of Southwest 35th Avenue Road in Marion Oaks after a third party called 911 reporting a domestic disturbance. According to investigators, James Cherry, 39, had gone to the residence of his estranged wife, attempted to gain entry after she refused to let him inside, and remained outside the home.
A Marion County deputy arrived and contacted Cherry outside the residence. According to the Sheriff's Office, Cherry produced a handgun, ignored repeated commands to drop it, and turned toward the deputy while still armed. The deputy fired, striking Cherry. The deputy immediately began rendering emergency medical aid until Marion County Fire Rescue personnel arrived. Cherry was transported to a local hospital, where he died from his injuries.
The Florida Department of Law Enforcement assumed the independent investigation into the shooting. Investigators processed the scene, documented the encounter, collected the firearm and other physical evidence, and interviewed witnesses. The deputy was placed on paid administrative leave in accordance with agency policy pending completion of the investigation.
Subsequent reporting identified the decedent as James Cherry, 39. Court records reviewed by local media indicated Cherry had an extensive criminal history that included approximately two decades of incarceration before his release in recent years. The circumstances of the deputy's use of force remain under review by FDLE.
