On 09/03/2021, 60-year-old Cedric Baxter was shot and killed by Buena Park Police Cpl. David Bernal and Officer Jonathan Choi at the Buena Park School District headquarters after an approximately 10-minute police pursuit. The Orange County District Attorney later reviewed the shooting and determined that Bernal and Choi were legally justified in using deadly force.

The encounter began shortly before 2 p.m. near Orangethorpe and Western avenues. Baxter's estranged wife was driving a Buena Park School District bus with a 6-year-old child aboard. According to investigators, Baxter followed the bus in a Chevrolet Tahoe, blocked its path, exited with a handgun and fired toward the front of the bus. His wife had an active domestic-violence restraining order against him. Police subsequently concluded that Baxter was attempting to kill her.

A Buena Park officer encountered the shooting while on patrol and attempted to stop Baxter. Baxter drove away and police pursued him. Dashcam footage subsequently released by police showed Baxter continuing to pursue and repeatedly ram the school bus while police followed. At one point he sideswiped the bus at an intersection.

The pursuit continued through Buena Park surface streets and into the school-district bus yard. Video showed Baxter driving over sidewalks and nearly colliding with a police cruiser. He eventually returned to the school district property, drove through a locked gate and crashed his Tahoe into a parked vehicle. The Orange County District Attorney's investigation described the pursuit as lasting nearly 10 minutes and occurring at high speed.

Bernal took over as the lead police vehicle during the pursuit. A police helicopter monitoring the chase warned officers about civilians in the school district area as the pursuit entered the property.

After crashing, Baxter opened the driver's door and emerged holding a handgun. Dashcam and body-camera recordings captured Bernal and Choi firing at him. Baxter fell behind the Tahoe while still holding the gun and appeared in the video to point it toward police as he rolled on the pavement. Officers continued ordering him to drop the weapon.

Baxter was struck multiple times and pronounced dead at the scene. Police recovered the handgun. His estranged wife and the 6-year-old child aboard the school bus survived.

Buena Park Police released dashcam and body-camera footage in November 2021. The recordings documented the school-bus ramming, pursuit, crash at the school district property, Baxter emerging with the handgun and the fatal exchange of gunfire.

The Orange County District Attorney's Office independently investigated Bernal and Choi's use of deadly force. In September 2022, prosecutors announced that neither officer was criminally culpable. Senior Deputy District Attorney Lexie Elliott concluded that Bernal and Choi were justified in using deadly force to protect themselves and others from Baxter.

On 09/03/2021, an unidentified woman from Mexico died after falling approximately 20 feet from a cliff while attempting to escape U.S. Border Patrol custody near the Rio Grande River in Laredo.

At approximately 6:00 a.m., a lone Border Patrol agent assigned to the Laredo South Station apprehended four migrants near the river, approximately 1.5 miles southeast of the Juarez-Lincoln Port of Entry. The agent handcuffed the four people together using three sets of handcuffs.

According to CBP, while the agent was helping the group through a barbed-wire fence toward a Border Patrol vehicle, the woman slipped one hand out of the handcuffs and ran toward the Rio Grande.

.

She ran approximately 50 feet in darkness before falling from a roughly 20-foot cliff. CBP reported that her head struck a log near the riverbank when she landed.

.

The Border Patrol agent requested emergency medical assistance and secured the other three detained migrants in the patrol vehicle. Laredo Fire Department personnel responded and pronounced the woman dead at the scene.

The woman was identified only as a Mexican citizen. Her name was not publicly released in the sources located for this update.

The Laredo Police Department and Webb County Medical Examiner's Office investigated the death. U.S. Customs and Border Protection's Office of Professional Responsibility also opened a review, and the Department of Homeland Security Office of Inspector General was notified.

At approximately 2:06 a.m., Lake Worth Officer R. Watson attempted to stop a white Volkswagen Jetta after observing it traveling approximately 88 mph in a 65-mph zone on Interstate 820. The driver continued driving away and turned off the vehicle's lights. Granado joined Watson as a backup officer during the pursuit.

Dispatch advised the officers that the Jetta was not stolen but had previously evaded another police agency and that its occupants were considered armed and dangerous. The pursuit traveled through Lake Worth and White Settlement into Fort Worth.

.

The Jetta struck a curb after exiting Interstate 30 near Horne Street, damaging a tire. The vehicle eventually stopped in the 3400 block of Horne Street, and the people inside ran in different directions. Ramirez had been a passenger, not the pursued driver.

.

Ramirez ran from the vehicle carrying a handgun. Watson pursued him on foot and ordered him to get on the ground. The later federal court record states that Ramirez dropped the gun during the encounter but immediately picked it back up. Watson briefly struggled with Ramirez before Ramirez continued running.

.

Granado subsequently maintained that Ramirez was swinging the handgun in the direction of Watson and Granado as he ran and that he believed Ramirez presented an immediate deadly threat. Granado fired seven rounds.

.

Evidence developed in the family's federal civil-rights lawsuit substantially disputed Granado's description of the shooting. Watson, who was closer to Ramirez, stated that Ramirez never pointed the gun toward him and never pointed it toward the officers while running away. Granado's body-camera footage likewise did not show Ramirez pointing or swinging the handgun toward either officer.

The body-camera recording also captured Granado asking Watson immediately after the shooting, “did he have a gun?” The Fifth Circuit later concluded that a jury could view this contemporaneous question as evidence contradicting Granado's later assertion that he saw Ramirez armed before and during the shooting.

.

The autopsy provided additional evidence inconsistent with Granado's account of an immediate frontal threat. Four of Granado's bullets struck Ramirez, including a fatal shot to the back of his head, and all four wound tracks traveled from back to front. Body-camera imagery showed Ramirez running away with his back toward both officers when Granado fired the fatal volley. Watson's service weapon remained holstered throughout the shooting.

Ramirez collapsed face-first in the direction he had been running. He died from the gunshot wounds.

.

The shooting was initially investigated by Fort Worth police. Lake Worth Police Chief J.T. Manoushagian publicly defended the shooting, saying video showed Ramirez with a gun and expressing confidence that the recordings would support the police account. The case was forwarded to the Tarrant County District Attorney's Office and a grand jury. Granado was not criminally charged.

Ramirez's mother, Juanita Ramirez, subsequently filed a federal civil-rights lawsuit against Granado and the City of Lake Worth alleging excessive force and inadequate training and supervision. The litigation directly challenged the police claim that Ramirez pointed or swung the gun toward officers and alleged that Granado shot Ramirez repeatedly in the back as he ran away.

In August 2024, U.S. District Judge Mark Pittman granted summary judgment to Granado, finding his use of deadly force objectively reasonable and granting him qualified immunity. The case was dismissed with prejudice.

Ramirez's family appealed. On 12/10/2025, the U.S. Court of Appeals for the Fifth Circuit reversed the summary judgment for Granado. The appellate majority held that the conflicting evidence—including Watson's statement, Granado's body-camera footage, Granado's immediate question about whether Ramirez had a gun, and the back-to-front bullet trajectories—created factual disputes that could not properly be resolved in Granado's favor at summary judgment.

The Fifth Circuit concluded that a reasonable jury could find that Ramirez did not point or swing the gun toward the officers and could disbelieve Granado's assertion that he perceived Ramirez as presenting the immediate deadly threat he later described. The ruling returned the excessive-force claim for further proceedings rather than clearing Granado of civil liability.

Granado sought rehearing. On 02/20/2026, the Fifth Circuit denied panel rehearing and rehearing en banc. Granado subsequently petitioned the U.S. Supreme Court. The civil litigation therefore remained active in 2026.

OFFICER BACKGROUND:

Jonathan Granado had been involved in a serious previous use-of-force incident less than a year before killing Ramirez. In November 2020, Granado attempted to stop motorcyclist Dustin Bates because his license plate was obscured and Granado believed the motorcycle might be stolen. Bates continued driving away and later ran on foot.

Granado pursued Bates in his police SUV and struck him with the vehicle. Dashcam video documented the collision. Bates suffered a fractured spine, three fractured ribs and a broken leg.

.

Lake Worth suspended Granado for two weeks and assigned him to administrative duty while the 2020 incident was investigated. An outside investigation characterized the collision as accidental, and a grand jury declined to indict Granado. Lake Worth nevertheless required Granado to undergo additional training and make a presentation to other officers about what he had learned and what he could have done better.

Bates filed a federal excessive-force lawsuit against Granado in January 2022, alleging Granado deliberately ran him down with the police SUV. The lawsuit brought renewed public scrutiny to Granado and resulted in Lake Worth Chief Manoushagian publicly confirming that Granado was also the previously unnamed officer who killed Ramirez.

Granado resigned from the Lake Worth Police Department in November 2021, approximately two months after killing Ramirez and several weeks before the criminal investigation into the Ramirez shooting was forwarded to the Tarrant County District Attorney's Office.

On 09/03/2021, at approximately 4:00 a.m., a Lawrence Police Department officer attempted to stop a Kia Soul for driving without headlights and displaying expired registration near Pendleton Pike and Mitthoeffer Road in Lawrence. The driver, later identified as 14-year-old Nazire Parks, continued driving away and officers pursued the vehicle.
The pursuit continued for more than 30 miles through Marion, Hamilton, and Boone counties. According to a later federal lawsuit filed by the families of two of the children, Lawrence police supervisors ordered the pursuit terminated after it reached Interstate 65. The lawsuit alleges that three officers turned off their emergency lights and sirens but continued following the Kia until it crashed. Lawrence Police have maintained that the officers were no longer engaged in an active pursuit at the time of the collision and that their actions complied with department policy. No officers were disciplined.
Near the intersection of State Road 32 and County Road 650 East in Boone County, the Kia left the roadway and struck a tree. Nazire Parks, who was driving, and front-seat passenger Kamyla Young, 13, died from their injuries. Four other juveniles in the vehicle were injured, including Janiya Young, who placed a 911 call during the chase telling dispatchers the driver was afraid to stop because he believed police would shoot him.
The Boone County Sheriff's Office investigated the crash with assistance from the Indiana State Police. Lawrence Police Chief Gary Woodruff stated that officers were found to have acted within department policy and that no disciplinary action was taken.
In June 2023, the families of Nazire Parks and Kamyla Young filed a federal civil rights lawsuit against the City of Lawrence and three Lawrence police officers. The lawsuit alleges the officers acted recklessly by continuing the pursuit after being ordered to terminate it and that their conduct caused the fatal crash. As part of the litigation, attorneys cited radio traffic, dispatch recordings, and the prolonged length of the pursuit.
An Indiana public-records dispute later confirmed that Lawrence Police withheld investigative reports, body-camera recordings, dash-camera recordings, and other materials while the investigation remained active. The department released its pursuit policy but declined to release most investigative records at that time.

On 09/03/2021, 52-year-old Lisa Garcia was shot and killed by Arapahoe County Sheriff’s deputies Joseph Hallett and Tyler Zimmerman at the Ivy Crossing Apartments in the 7500 block of East Harvard Avenue. Denver police were seeking Garcia on a first-degree murder warrant in the July 24 shooting death of her relative, 41-year-old Neomi Tafoya. A Crime Stoppers tip led investigators to Garcia’s location. Arapahoe County’s Special Response Team was asked to assist with her arrest.

.

Deputies positively identified Garcia during surveillance and approached her outside the apartment complex. Garcia ran. Body-camera footage recorded a deputy ordering her to stop and a female voice saying, “I've got a gun.” Garcia then removed a black handgun from her purse.

.

According to the subsequent district attorney investigation and body-camera evidence, Garcia turned toward Hallett and pointed the handgun at him with both hands in a shooting stance. Hallett dropped to a kneeling position and fired his rifle. Zimmerman reported seeing Garcia raise the handgun toward Hallett and fired two rifle rounds from approximately 25 yards away.

Hallett and Zimmerman fired a combined nine rounds. Garcia fell facedown with the handgun and her hands beneath her body. Deputy Justin Yantiss subsequently fired two 40mm less-lethal impact rounds at Garcia when she did not comply with commands to show her hands. Deputies then approached and attempted first aid. Garcia died at the scene.

The weapon Garcia pointed at deputies was subsequently determined to be an airsoft pistol. It was black, metallic-looking and lacked an orange tip.

.

The autopsy found gunshot wounds to Garcia’s chest, shoulder, neck and fingers and determined that she died from gunshot wounds.

The 18th Judicial District Critical Incident Response Team investigated the shooting. Aurora Police Detective Eric White served as lead investigator. The investigation included body-camera footage, officer interviews, ballistic evidence and autopsy findings.

On 12/27/2021, the 18th Judicial District Attorney’s Office ruled the shooting legally justified. Prosecutors concluded that Hallett and Zimmerman reasonably believed Garcia presented an imminent threat of death or serious bodily injury when she pointed what appeared to be a handgun at Hallett. Neither deputy was criminally charged. Yantiss’s subsequent use of the 40mm less-lethal rounds was also found reasonable.

On 09/03/2021, 37-year-old Drew Lucero was shot and killed by Westminster Police Department officers Anthony Stroup, Chris Neal and Kevin Flores while officers attempted to arrest him at 5343 Billings Street in Denver.

Westminster police were seeking Lucero on warrants for attempted murder, first-degree assault and first-degree burglary. The charges stemmed from a 09/16/2020 incident in which police alleged Lucero shot his former girlfriend. On 09/02/2021, the same woman reported that Lucero had returned to her home, threatened her and damaged property.

.

Investigators located Lucero's vehicle outside the Billings Street residence. Four Westminster officers conducted surveillance for more than four hours before Lucero came out of the house at approximately 7:30 p.m.

.

According to the Denver District Attorney's investigation, when the officers emerged from their surveillance van, Lucero pulled a handgun and fired one round toward them. Police returned fire, and Lucero moved behind a parked vehicle.

.

Police used a flash-bang grenade while advancing on Lucero and deployed a police dog, which bit Lucero on the leg. Stroup, Neal and Flores fired their weapons while advancing. The officers reported that Lucero pointed his handgun toward them more than once.

.

The three officers fired a combined 27 rounds. Lucero was struck in the right shoulder, right chest, left calf, lower right back and lower left back.

.

Police took Lucero into custody and transported him to Denver Health Medical Center. He died less than two hours after the shooting. The autopsy determined that he died from multiple gunshot wounds.

.

A multi-agency team involving Denver and Aurora police investigated the shooting. On 11/29/2021, Denver District Attorney Beth McCann ruled that Stroup, Neal and Flores were legally justified in shooting Lucero and declined to file criminal charges.

OFFICER BACKGROUND:

Anthony Stroup had previously participated in the fatal 05/04/2016 police shooting of Damon Blair in Westminster. Blair allegedly fired at Officer Steven Stockman during an attempted arrest. Stroup fired eight rounds; four other Westminster officers also fired, for a combined 46 police rounds. Blair was struck 13 times. The 17th Judicial District Attorney ruled that shooting justified.

Stroup was also named as a defendant in a 2019 federal civil-rights lawsuit, Cushinberry v. City of Westminster, along with Westminster Officer Koltin Fatzinger and another officer. The case was filed under 42 U.S.C. §1983. The docket establishes the lawsuit but not a finding of liability against Stroup.

On 09/03/2021, at approximately 4:00 a.m., a Lawrence Police Department officer attempted to stop a Kia Soul for driving without headlights and displaying expired registration near Pendleton Pike and Mitthoeffer Road in Lawrence. The driver, later identified as 14-year-old Nazire Parks, continued driving away and officers pursued the vehicle.
The pursuit continued for more than 30 miles through Marion, Hamilton, and Boone counties. According to a later federal lawsuit filed by the families of two of the children, Lawrence police supervisors ordered the pursuit terminated after it reached Interstate 65. The lawsuit alleges that three officers turned off their emergency lights and sirens but continued following the Kia until it crashed. Lawrence Police have maintained that the officers were no longer engaged in an active pursuit at the time of the collision and that their actions complied with department policy. No officers were disciplined.
Near the intersection of State Road 32 and County Road 650 East in Boone County, the Kia left the roadway and struck a tree. Nazire Parks, who was driving, and front-seat passenger Kamyla Young, 13, died from their injuries. Four other juveniles in the vehicle were injured, including Janiya Young, who placed a 911 call during the chase telling dispatchers the driver was afraid to stop because he believed police would shoot him.

Police converged on the Walmart. Marshall left in another stolen vehicle and police pursued him south on Interstate 94 at speeds exceeding 110 mph. He exited at West Elm Road and continued north on South 27th Street.

REASON FOR POLICE CHASE:
Human-trafficking investigation. LAPD Hollywood Division vice officers were conducting an undercover human-trafficking operation near Melrose Avenue and Western Avenue when they observed a black Mercedes-Benz drop off a woman whom police believed was being trafficked. Vice officers attempted to stop the Mercedes, but police said the driver continued driving away and officers pursued.

EVENT NARRATIVE:
On 09/03/2021, 31-year-old Dionicio Baten Ajanel of Los Angeles was killed when a Mercedes-Benz being pursued by Los Angeles Police Department Hollywood Division vice officers crashed into his vehicle at West 6th Street and South Wilton Place in Koreatown.

The encounter began shortly before 11:00 a.m. while Hollywood Division vice officers were conducting an undercover human-trafficking investigation near Melrose and Western avenues. Police said officers observed a black Mercedes drop off a woman they believed was being trafficked. The officers attempted to stop the Mercedes in connection with that investigation.

Police said the Mercedes accelerated away and the vice officers pursued. The chase traveled south from the Hollywood area toward Koreatown and lasted approximately two minutes. Available public reporting does not provide a documented maximum speed, total pursuit distance, or the following distance between the pursuing police vehicle and the Mercedes immediately before the collision.

The pursuit reached the area of West 6th Street and South Wilton Place. Police said the Mercedes was traveling south on Wilton Place when it entered the intersection and collided with another vehicle traveling west on 6th Street.

The force of that collision sent the Mercedes into Baten Ajanel's vehicle. Baten Ajanel was an uninvolved motorist and had no connection to the human-trafficking investigation or the people police were pursuing. He suffered fatal injuries and died at the scene. Another uninvolved motorist was injured and hospitalized but survived.

The Mercedes was severely damaged in the collision. Two men inside were taken into custody and transported to hospitals for treatment. Police subsequently identified them as brothers Keith Sparrow, 21, and Julian Sparrow, 22, both of Los Angeles. Investigators initially said they had not determined which brother had been driving the Mercedes.

The two men were booked on suspicion of human trafficking. Both were subsequently released on bail while the Los Angeles County District Attorney's Office considered charges arising from the fatal collision. Contemporary reporting indicated that investigators were also considering potential homicide charges related to Baten Ajanel's death.

Federal prosecutors alleged that Vos conspired to distribute 50 grams or more of methamphetamine and possessed 50 grams or more with intent to distribute on 10/21/2020.

The police operation continued for several hours. When officers eventually entered the residence, they found Vos dead. Police stated that Vos had killed himself before officers made contact with him. Clearfield County Coroner Kim Shaffer-Snyder was called to the scene at 5:04 p.m.

Dreith arrived as a cover officer. At approximately 12:20 p.m., Derby returned to the motorcycle and Dreith began speaking with him while another deputy continued checking the motorcycle. Derby told Dreith he had been riding the motorcycle when it broke down.

Body-camera footage showed Derby reach toward a backpack on the motorcycle. Dreith told him to leave the backpack alone. Derby began walking away. Dreith told him the motorcycle was stolen and grabbed his arm. Derby pushed Dreith away and said the motorcycle was not stolen.
.
The bodycam showed Derby pull a handgun from his waistband and point it toward Dreith. The sequence happened within seconds: at 34 seconds into the recorded contact Dreith told Derby the motorcycle was stolen; at 35 seconds Derby pushed him away; at 36-37 seconds Derby drew the gun; at 38 seconds Dreith began firing; and at 41 seconds Dreith fired his final round.

Dreith fired 11 rounds. Investigators determined that one of Dreith’s bullets struck Derby’s right hand and his Taurus PT709 9mm handgun, severely damaging the weapon and propelling it from his hand.

The autopsy documented 10 gunshot wounds and two graze wounds. Most of the bullet trajectories were from back to front. Wounds included Derby’s posterior shoulder, upper and lower back, buttock, hip, thigh, foot and hand. He died from multiple gunshot wounds; the death was ruled a homicide.

Bodycam review showed that as Derby turned away during the shooting, his handgun was knocked from his hand and was airborne. The deputies did not perceive this during the shooting and initially believed the gun remained beneath or near Derby. The handgun was located several feet away approximately 2 minutes and 43 seconds after the shooting.

The recovered Taurus had one round chambered and six rounds remaining in the magazine. Laboratory testing determined that the handgun had been functional before it was struck by Dreith’s bullet.

The First Judicial District Critical Incident Response Team investigated the shooting, led by Arvada Police Commander Anthony Baros. The investigation was submitted to the First Judicial District Attorney’s Office on 11/05/2021.

On 09/02/2021, Michael Ouellette, 37, died from a self-inflicted gunshot wound following an exchange of gunfire with Bristol Police Department personnel on Water Street in Warren. Ouellette was president of the Italo-American Club at 13 Kelly Street, where police alleged that he had shot and killed Warren Assistant Fire Chief Brian Remy, 66, and wounded Jason Furtado, 41, shortly before the police encounter.

After leaving the club, Ouellette returned to the area of his residence at 135 Water Street. Bristol Police Chief Kevin Lynch and Major Scott McNally were traveling to Warren to assist officers responding to the active-shooter call when they encountered Ouellette on Water Street.

Police reported that Ouellette fired at Lynch and McNally. McNally took cover and returned fire while directing nearby civilians to move away from the gunfire. Ouellette subsequently stopped firing and retreated through the gate beside his Water Street residence.

Police then heard another gunshot. Officers approaching the property found Ouellette dead in the alley just inside the gate. Because McNally had fired during the encounter, authorities initially did not know whether Ouellette had been killed by police gunfire or had shot himself.

The Rhode Island Office of State Medical Examiners subsequently determined that Ouellette died from a self-inflicted gunshot wound. Investigators determined that McNally's gunfire did not kill him. Neighbor-recorded video also captured a man matching Ouellette's appearance shooting himself after entering the alley.

The Rhode Island Attorney General's Office, Rhode Island State Police, Warren Police Department and Bristol Police Department investigated the shootings and Ouellette's death. His death is classified as suicide under police duress because he fatally shot himself immediately after exchanging gunfire with police while officers were actively attempting to apprehend him.

Lazano drove into the front yard of a residence. A Precinct 1 sergeant positioned a marked patrol vehicle to block the driveway. Police said Lazano rapidly reversed the SUV into the house with enough force that the rear portion of the vehicle entered the structure.

As deputies surrounded the SUV, Lazano drove forward. Video released after the shooting showed the SUV striking a Precinct 1 deputy and dragging him approximately 20 feet before crashing into the marked patrol vehicle blocking the driveway.

McDaniel positioned himself on elevated terrain overlooking deputies and nearby homes. Deputies heard a gunshot and located him carrying a handgun. Crisis negotiators established intermittent contact with him and negotiated for several hours. McDaniel repeatedly said he intended to kill himself and told deputies that if they approached him, they would be shot.

Deputies provided McDaniel with cigarettes and a cellphone so he could communicate with police, relatives and a civilian mental-health professional. Police said McDaniel had been drinking alcohol. He repeatedly declined requests to put down the handgun.

During the standoff, McDaniel repeatedly fired his handgun in different directions. Investigators determined that he fired at least 23 rounds during the incident. A shelter-in-place order was issued for surrounding residents at approximately 7 p.m.

Deputy Ryan Gonzales reported seeing McDaniel aim his handgun toward deputies and fire three or four rounds in their direction. Investigators documented a bullet impact on McDaniel’s vehicle that was in line with Gonzales’s position. Gonzales returned fire.

After approximately three-and-a-half hours of negotiations, McDaniel moved down the opposite side of the hill toward deputies Andrew Peery and David Fisher while still carrying the handgun. Peery and Fisher reported seeing McDaniel move the weapon across his chest while looking toward them. Peery fired his rifle twice and Fisher fired his handgun once. McDaniel was struck by multiple police rounds and fell.

Deputies subsequently fired a 40mm less-lethal impact round when McDaniel remained unresponsive, then approached him and found no pulse. He died at the scene.

Schilly refused Khars’s request for her driver’s license and rolled up her window. When Marcal attempted to open her door, Schilly began driving away. Marcal testified that the SUV struck and dragged him briefly before he fell away from it. Khars and Marcal then pursued Schilly in separate vehicles with emergency lights activated.

The pursuit continued over several streets while traffic signals remained inoperative because of Hurricane Ida. Schilly eventually stopped in traffic on Veterans Memorial Boulevard. Marcal approached the driver’s side of her SUV on foot while Khars approached from behind with his gun drawn.

Marcal stood near the front driver’s side of the SUV and repeatedly told Schilly to stop. According to the officers, Schilly began moving the SUV forward toward Marcal. Khars fired multiple rounds into the vehicle, killing her. Khars later testified that he fired because he believed Schilly was about to run over Marcal.

Schilly’s children, Jade Schilly Dauterive and Tylere Schilly, disputed the justification for the shooting. In 2022, they sued Khars, Marcal and Sheriff Joseph Lopinto in federal court, alleging excessive force, failure to intervene, battery, negligence, wrongful death and survival claims. They argued that the deputies knew their mother was mentally ill and that Khars unnecessarily escalated a mental-health intervention into a fatal encounter.

The family specifically disputed that Schilly posed an immediate threat requiring deadly force. Their case argued that Marcal was not directly in front of the SUV when Khars fired and that Khars could not reasonably have believed deadly force was necessary to protect him. On 12/15/2025, U.S. District Judge Darrel James Papillion granted summary judgment to Khars, Marcal and Lopinto and dismissed the family’s claims with prejudice. Dilling located Brown within minutes near South Avenue and Fountain Street. Brown ran and Dilling pursued him on foot. Brown climbed over a chain-link fence and fell to the ground on the other side.

Dilling caught up with Brown and ordered him to show his hands. As Dilling attempted to help Brown stand, Brown reached toward his side and produced a handgun. Body-camera footage showed Dilling repeatedly ordering Brown to stop and telling him that he wanted to help him.

Brown raised the handgun to his own head and fired. Dilling fired his service weapon at approximately the same time, striking Brown in the thigh. Dilling immediately rendered first aid, but Brown died from the gunshot wound to his head.

The preliminary autopsy determined that Brown's fatal head wound was self-inflicted and that Dilling's bullet caused the nonfatal leg wound. Brown's weapon was identified as a Smith & Wesson semiautomatic handgun.

Battle Creek Police Chief Jim Blocker publicly released and reviewed Dilling's body-camera footage the following day. Michigan State Police conducted the independent investigation into Dilling's shooting.

On 08/31/2021, shortly before 1:30 p.m., Houston Police Department officers responded to the 7100 block of Hillcroft Avenue after receiving a report that a 51-year-old man was assaulting his wife. When officers arrived, the man had already left the location in a gray Honda Accord. Police alleged that the woman suffered injuries during the assault and transported her to an area hospital for treatment.
According to HPD, the man drove north on Hillcroft Avenue after leaving the domestic disturbance. In the 7200 block, he lost control of the Honda and struck the rear of a black Ford F-450 tow truck. The crash occurred only about one block from the location where police had responded to the domestic violence call.
Emergency personnel transported the man to Memorial Hermann-Texas Medical Center, where he died from his injuries. The Ford driver was not injured. HPD's Vehicular Crimes Division assigned Sgt. P. Lee and Officer D. Ortega to investigate the fatal crash under incident number 117620921-Q. Those officers were crash investigators and should not be identified as officers involved in the preceding encounter.

On 08/31/2021, at approximately 3:30 p.m., Mesa Police Department undercover detectives were conducting surveillance of 26-year-old Mesa resident Dakota Black while investigating him in connection with an alleged armed robbery. Black was driving a white Chevrolet pickup truck eastbound on Broadway Road when he entered the southbound Loop 202 on-ramp.
Police alleged that Black stopped the pickup on the freeway ramp, got out and attempted to carjack the driver of a passenger vehicle. The alleged carjacking was unsuccessful, and Black returned to his pickup. Mesa Police undercover detectives, assisted by members of a U.S. Marshals Service Fugitive Task Force, then moved in and used their vehicles to box in Black's truck.
Officers approached the immobilized pickup intending to arrest Black but found him unresponsive inside. Police initially treated the incident as a possible shooting but reported that no law-enforcement officer had fired a weapon. Mesa Fire and Medical Department personnel responded and pronounced Black dead at the scene.
On 09/01/2021, Mesa Police announced that investigators had determined Black died from a self-inflicted gunshot wound. Police reported finding the handgun in Black's lap and concluded that he shot himself inside the pickup moments before officers reached him.

On 08/31/2021, at approximately 11:55 a.m., Anaheim Police Department officers responded to a residence in the 2400 block of West Greenleaf Avenue after a man called police and reported that he had been shot. Officers entered the residence and found 61-year-old David Erickson of Anaheim suffering from fatal gunshot wounds. Erickson was subsequently identified as the person who had called police.
While officers were inside the residence, they encountered 55-year-old Robert Nelson. Anaheim Police alleged that Nelson was armed when officers confronted him. At least one Anaheim officer opened fire on Nelson. The initial responding officers then withdrew from the residence rather than continuing farther into the home, and the department deployed its SWAT team.
SWAT officers subsequently entered the residence and found both Erickson and Nelson dead. Police determined that Nelson had been struck by police gunfire. On 08/31/2021, at approximately 6:55 p.m., Metropolitan Police Department Third District officers responded to an apartment building in the 1400 block of V Street NW after a caller reported seeing a man on a balcony holding what appeared to be a long gun. Officers were directed to the apartment of 34-year-old George David Watson and approached his door.
Officers made contact with Watson and spoke with him in the hallway. Watson went back inside his apartment and subsequently came out again, continuing to speak with officers before returning inside. Police remained positioned outside the apartment and attempted to communicate with him rather than immediately entering the residence. Watson emerged from the apartment three times during the encounter.
On the third occasion, Watson came through the doorway carrying what appeared to officers to be a rifle. MPD alleged that Watson pointed the object toward officers. Sergeant Jonathan Nelson, a 12-year MPD veteran assigned to the Third District, opened fire, striking Watson multiple times.
The object Watson was carrying was subsequently determined not to be a firearm. It was a replica/airsoft-style rifle. MPD Chief Robert Contee said shortly after the shooting that the object appeared to be an airsoft rifle or possibly a paintball gun but argued that it looked like an actual firearm when Watson displayed it. The District's later official use-of-force review specifically classified the weapon as a replica.
An MPD officer also suffered a gunshot wound to the hand during the encounter. Contemporary reporting initially left unclear how that officer had been shot, particularly because Watson's weapon was not an actual firearm. The publicly released information establishes that Nelson was the MPD officer who fired the fatal gunfire at Watson.

On 08/31/2021, at approximately 8:00 p.m., emergency personnel responded to a reported structure fire on a rural property in the 23000 block of 42nd Street southeast of Martelle. The property belonged to the maternal grandparents of 45-year-old Jeremy Michael Berg, who was living there at the time. Eleven law-enforcement and fire agencies ultimately responded. Berg had suffered significant burns while near or inside the burning outbuilding before police confronted him.
Dispatchers advised responding officers that Berg had a history of drug use and had reportedly been repeatedly entering the burning structure while talking about dying in the fire. Berg's mother later said he struggled with depression and methamphetamine addiction and believed it was possible that he intended to provoke police into killing him. Family members reported that Berg had used drugs that evening.
Jones County Sheriff's Deputy James Rickels arrived at approximately 8:17 p.m. and encountered Berg sitting on the ground with visible burns. Rickels attempted to keep Berg away from the fire while waiting for paramedics. According to the Iowa Attorney General's subsequent investigation, Berg then produced a knife. Rickels and members of Berg's family repeatedly attempted to persuade him to put it down.
Rickels deployed his Taser, causing Berg to fall. According to the state investigation, Berg pulled the Taser probes from his body, stood back up and continued holding the knife. Rickels deployed the Taser a second time without incapacitating him. Jones County Deputy Tim Miller subsequently arrived, followed at approximately 8:30 p.m. by Anamosa Police Sgt. Nick Brokaw and Officers Gabe Humphrey and Tyler Hunt.
Police continued attempting to persuade Berg to put down the knife during a standoff lasting several minutes. Officers then escalated their less-lethal efforts, firing a beanbag round and deploying another Taser. According to investigators, neither incapacitated Berg. Berg then ran away from the officers toward a nearby house, and several officers pursued him.
The state's investigation alleged that while officers pursued him, Berg stopped, turned toward them, yelled and raised the hand holding the knife. Police alleged that Berg then moved rapidly toward the officers. The publicly released body-camera segment shows Berg initially running away from police before officers pursue him; seconds later, he turns with his right arm raised and moves back in the officers' direction.
Deputies James Rickels and Tim Miller and Anamosa officers Nick Brokaw, Gabe Humphrey and Tyler Hunt then simultaneously opened fire. Approximately eight to ten shots can be heard in the publicly released 15-second body-camera segment. Berg was struck multiple times and fell to the ground. Officers removed the knife and began providing emergency medical aid, but Berg died from multiple gunshot wounds.
Berg's family questioned the officers' decision to pursue him when he ran away. His mother, Margie Fensterman, said relatives at the scene wanted to approach Berg and attempt to persuade him to surrender the knife but police prevented them from doing so. She described the knife as a pocket knife and questioned why officers did not allow Berg to continue running away rather than pursuing him. She also believed her son's behavior may have represented an attempt to make police kill him.
The Iowa Division of Criminal Investigation investigated the shooting. Because Jones County Attorney Kristofer Lyons identified a potential conflict of interest, the case was referred to the Iowa Attorney General's Office for an independent review. On 09/17/2021, Assistant Attorney General Douglas Hammerand concluded that all five officers were legally justified in using deadly force and closed the Attorney General's criminal review without charges.
All five shooters had been placed on administrative leave. At the time of the shooting, Rickels had approximately six years of law-enforcement experience, Miller three years, Brokaw nine years, Hunt eight years and Humphrey two years. On 08/30/2021, shortly after 1:00 p.m., Brevard County Sheriff’s Deputy Brian Potters conducted a traffic stop on a vehicle traveling on West New Haven Avenue/U.S. 192 just west of Interstate 95 in the West Melbourne area. Deputy Tyler Thoman arrived shortly afterward to assist. Three adults and a two-month-old infant were inside the vehicle. Thirty-eight-year-old Paris Wilder of Cocoa was sitting in the rear passenger seat.
Dash-camera video released by the Brevard County Sheriff’s Office provides unusually extensive documentation of what happened next. While deputies spoke with the people in the vehicle, Potters offered to hold the infant while the adults got out. Wilder then emerged from the rear passenger side carrying a short-stock rifle and immediately began firing. Wilder shot Potters in the lower leg as Potters moved away from the vehicle. Both Potters and Thoman returned fire.
The exchange continued around the vehicles. Wilder was struck by police gunfire but remained mobile. According to the Sheriff’s Office and the released video, Wilder's rifle eventually malfunctioned or became unusable. Wilder then approached Potters from behind and repeatedly struck him in the head with the rifle while Potters was on or near the ground. Potters suffered a gunshot wound to his leg as well as head lacerations, a concussion and facial fractures.
Thoman moved toward Wilder and Potters during the struggle and fired multiple additional rounds at Wilder at close range. Wilder was struck and killed. Subsequent reporting specifically identified Thoman as the deputy who fired the final fatal gunfire, while both Thoman and Potters had fired during the preceding exchange.
The Sheriff’s Office alleged that Wilder had two outstanding felony warrants and was out on bond in two felony drug cases when the traffic stop occurred. Sheriff Wayne Ivey subsequently emphasized Wilder's extensive arrest history in public statements about the killing. Those allegations concerned Wilder's prior criminal history and were separate from the circumstances that initially caused Potters to stop the vehicle. On 08/30/2021, at approximately 4:15 p.m., a Miami Shores Police Department officer responded to 68 NW 95th Street after police received a disturbance call involving 48-year-old Etianna Planellas. Police had responded to the residence on previous occasions. Planellas's relatives and longtime family friends said she had struggled with serious mental illness and depression for years and had previously been hospitalized for psychiatric treatment.
Family members said Planellas was intoxicated that afternoon. Other reporting based on interviews with people close to her stated that shortly before police arrived, Planellas had threatened to kill herself. She lived at the residence with several family members, including elderly relatives, and was described by a longtime family friend as the person who largely cared for the household.
According to Miami Shores Police Chief Kevin Lystad, the first responding officer encountered Planellas outside the residence holding what appeared to be a semiautomatic handgun. Police alleged that Planellas pointed the object toward the officer. Lystad said there was some dialogue between the officer and Planellas, including commands for her to put the weapon down, before the officer opened fire.
The officer fired multiple rounds, striking Planellas and killing her outside her home. A neighbor described hearing a rapid succession of gunshots. Planellas's relatives said she was killed in front of her elderly mother. No evidence located indicates that Planellas fired at the officer.
After the shooting, police discovered that the purported handgun was not a firearm. It was a black pellet/BB pistol made to resemble a semiautomatic handgun. Miami Shores Police released a photograph of the pellet gun after Planellas's death.
Planellas's relatives and friends publicly criticized the killing and questioned why an officer responding to a person with a known history of mental illness did not use a less-lethal response. Family friend Jorge Rodriguez described the shooting as excessive, while another longtime friend said officers should have recognized that Planellas was experiencing a psychiatric crisis.
The Florida Department of Law Enforcement assumed responsibility for the investigation into the police shooting, with Miami-Dade Police homicide detectives also participating. On 08/30/2021, at approximately 8:24 p.m., a Coconut Creek Police Department officer stopped 36-year-old Brittni A. Muldrew while she was driving a white Mercedes-Benz westbound in the 4400 block of West Hillsboro Boulevard. Police said the officer initially stopped the vehicle for speeding. During the traffic stop, the officer learned that the Mercedes had recently been reported stolen in Parkland and called for additional officers. Two additional officers arrived while Muldrew and a male passenger remained inside the vehicle.
Police alleged that after backup officers arrived, Muldrew reversed the Mercedes in the direction of officers. Coconut Creek Police initially reported that two officers opened fire, striking Muldrew. Muldrew was shot multiple times and died at the scene despite officers' attempts to provide medical assistance. Three officers were treated at a hospital for injuries, and a police K-9 was also injured.
Later-released police dash-camera and body-camera recordings provided considerably more information about the encounter. The recordings show officers holding Muldrew at gunpoint for several minutes after determining that the Mercedes had been reported stolen. The encounter lasted approximately 11 minutes from the initial traffic stop until Muldrew's death. The video shows the Mercedes reversing before stopping and officers firing into the vehicle.
The subsequent federal civil-rights lawsuit filed by Muldrew's family identified Coconut Creek officers Andrea Calderon, Alejandro Escobar, Amanda Cummings, Arthur Patton and Ty Morgan as officers involved in the encounter. The lawsuit alleged that Calderon, Escobar, Cummings and Patton had their firearms drawn and pointed toward Muldrew immediately before the shooting and alleged that they opened fire. A federal judge later noted that the complaint alleged Muldrew was struck by nine gunshots. The original police account, however, stated that two officers fired, so the precise allocation of the gunfire among the four officers remained disputed in the civil litigation.
The released recordings also revealed a significant use-of-force allegation that was not part of the original 2021 reporting. After officers removed the wounded Muldrew from the Mercedes, Officer Ty Morgan approached her with an expandable baton and struck her in the head. Video obtained through public-records requests reportedly shows Muldrew still exhibiting signs of life during this period, with an officer heard saying that she had a pulse. Muldrew's family alleged Morgan repeatedly struck her while she was incapacitated on the pavement.
The Florida Department of Law Enforcement investigated the police use of deadly force and subsequently forwarded its investigation to the Broward State Attorney's Office for prosecutorial review. The two officers initially identified by the department as having fired were placed on administrative leave following the killing.
Muldrew's mother, Vicki Waters, acting as personal representative of her daughter's estate, subsequently filed a federal wrongful-death and civil-rights lawsuit against the City of Coconut Creek and officers Calderon, Escobar, Cummings, Patton and Morgan. The court likewise declined to dismiss the excessive-force claim against Morgan concerning the alleged baton strikes because it had not been established that Muldrew was already dead when Morgan used the baton. Failure-to-intervene claims against Calderon, Escobar, Cummings and Patton also survived that dismissal motion.
The litigation therefore produced officer identities and evidence that were unavailable in the original reporting and materially changes the original skeleton record. The officers associated with the gunfire are Calderon, Escobar, Cummings and Patton; Morgan is separately identified as the officer accused of striking Muldrew with a baton after she had been shot.

Officers arrived to find several people already suffering from gunshot wounds. Police identified 66-year-old Ronald J. Reiner as the person they alleged had carried out the shootings.
Officers initially divided their response between searching for the gunman and providing emergency aid to people who had been shot. According to the subsequent investigation, officers heard additional gunfire after arriving. While one officer was providing aid to a wounded person with his handgun holstered, Reiner moved toward the area where the officer and injured person were located.
Police alleged that Reiner was armed with a handgun and fired at responding officers. Normal Police Officers Shane Bachman, Evan Easter and Cory Phillips exchanged gunfire with Reiner while moving through the densely populated mobile home park. Body-camera and dashboard-camera recordings captured substantial portions of the confrontation. All three officers fired their service weapons during the encounter.
Bachman, Easter and Phillips shot Reiner, killing him at the scene. Two other people, 64-year-old Sharon Reiner and 59-year-old Julie Davis, were also killed during the incident, and three men, ages 62, 58 and 34, suffered gunshot wounds. The Illinois State Police investigated the police shooting. The incident occurred as Hurricane Ida was producing tropical-storm-force winds, heavy rain and severe flooding across the area. Deputies could not reach the residence normally because floodwaters surrounded the property and were reportedly as deep as nine feet in some areas, forcing deputies to approach the scene by boat.
The shooting victim was 65-year-old George Hobart Shaw, who owned the Kelly Road residence. Eighty-year-old Martin Luther Bowman III lived at the home with Shaw. Bowman was well known locally by the nickname “Captain Foo” or “The Captain.” Authorities alleged that Bowman shot Shaw during the early-morning hours. Shaw suffered a fatal gunshot wound.
After deputies reached the flooded property, they attempted to make contact with Bowman. Contemporary reporting described what followed as a standoff. On 08/29/2021, Sacramento Police Department officers responded to a burglary at a marijuana dispensary in Rancho Cordova. As several individuals left the scene in two vehicles, Officer Mitchell Barrett attempted to stop one of them. The driver, identified as 20-year-old Amelian Houff of Hayward, continued driving while Barrett pursued for approximately one mile along Elder Creek Road. During the pursuit, Houff's vehicle was reported to be traveling at speeds exceeding 100 mph before it left the roadway near the intersection of Elder Creek Road and Bradshaw Road and crashed violently into a tree, becoming lodged several feet above the ground in the tree's branches.

The complaint further alleges that Ellis ordered the only ambulance that had staged nearby to leave the scene even though Houff continued calling for help. Sacramento County Sheriff's Sgt. In 2022, Houff's parents filed a federal wrongful death and civil rights lawsuit represented by civil rights attorney John L. Burris, alleging that although the crash caused catastrophic injuries, law enforcement officers violated Houff's constitutional rights by deliberately delaying lifesaving medical care and preventing emergency medical personnel from treating him while he remained alive. The lawsuit names Officer Mitchell Barrett, Sgt. Michael Frazier, Lt. Brian Scott Ellis, Sgt. Jim Spurgeon, Lt. Michael Daniels, the City of Sacramento, Sacramento Police Department personnel, Sacramento County, and Sacramento County Sheriff's Office personnel.

On 08/29/2021, at approximately 4:15 a.m., two off-duty New York City Police Department officers who had just completed their shifts at the nearby 46th Precinct encountered a confrontation outside a grocery store at 2080 Valentine Avenue near East 180th Street in the Fordham Heights section of the Bronx. Twenty-four-year-old Michael Rosado and his father, Rafael Rosado, were involved in a dispute with a group of people that escalated into a physical altercation.
According to the NYPD, Michael Rosado allegedly produced a handgun and fired multiple rounds during the dispute. The two off-duty officers heard or observed the gunfire and intervened. Police alleged that Rosado then fired multiple rounds toward the officers. Both officers returned fire, striking Rosado in the torso.
After Rosado was shot and fell, police alleged that his father picked up his son's handgun and fired multiple rounds toward one of the officers. Surveillance video documented portions of the confrontation. Neither off-duty officer was struck by the gunfire. Rafael Rosado was subsequently taken into custody.
The officers provided medical assistance to Michael Rosado after the gunfire ended. Emergency medical personnel transported him to St. Barnabas Hospital, where he was pronounced dead. The New York State Attorney General's Office later confirmed that two off-duty NYPD officers fired at Rosado and that at least one of their shots caused his death.
Because the shooting resulted in a civilian death caused by police, the New York Attorney General's Office of Special Investigation opened an independent investigation. Investigators obtained surveillance recordings from a private business showing portions of the encounter, and Attorney General Letitia James publicly released two of those recordings on 10/01/2021.
The separate criminal case against Rafael Rosado continued after his son's death. On 08/29/2021, at approximately 12:04 p.m., Falls Township Police Department officers responded to 417 Federal Lane after receiving a report of a domestic disturbance involving 48-year-old Jorge Alberto Perez and his longtime partner. The couple had been arguing after Perez's partner told him their relationship was over. She passed a note to her 19-year-old son asking him to call police.
Before officers arrived, authorities alleged that Perez placed several knives in the kitchen sink but retained a 12-inch carving knife and went to the lower level of the split-level residence. The first responding officer, a seven-year veteran of the Falls Township Police Department, spoke with Perez's partner and son before going downstairs to contact Perez. A second officer, a 21-year department veteran, arrived shortly afterward.
According to the subsequent Bucks County District Attorney investigation, the officers encountered Perez in the basement holding the knife. Police alleged that Perez disregarded repeated commands to put it down. One officer attempted to use less-lethal force before the fatal shooting. The District Attorney's account states that the officers continued ordering Perez to drop the knife as the confrontation escalated.
Police alleged that Perez subsequently advanced toward the officers while holding the knife. One of the officers fired a single round from his service handgun, striking Perez in the chest. The autopsy subsequently determined that Perez died from that single police gunshot.
One of the responding officers, who was also a trained paramedic, immediately began providing emergency medical treatment. Levittown-Fairless Hills Rescue Squad personnel arrived and continued efforts to save Perez. After consultation with a physician at St. Mary Medical Center, Perez was pronounced dead at the residence.
The Bucks County District Attorney's Office assumed responsibility for independently investigating the fatal shooting. Investigators reviewed the officers' actions and the circumstances surrounding the domestic disturbance and police confrontation. On 11/10/2021, District Attorney Matt Weintraub announced that the shooting was legally justified and closed the criminal investigation without charges against either officer. Weintraub concluded that the officers reasonably believed their lives were in immediate danger when the fatal shot was fired.
The Falls Township Police Department did not publicly identify either officer. The District Attorney instead referred to them as Officer 1 and Officer 2. Public reporting established that one had seven years of service and the other had 21 years with the department.

On 08/29/2021, San Bernardino County Sheriff’s Department deputies responded to a residence on Zenda Street in Victorville after a woman and her mother called 911 about 32-year-old Albert “AJ” Ruiz Perez Jr. According to the later District Attorney investigation, Perez and the woman had been arguing in her garage when she alleged that Perez produced a handgun. She told dispatchers that Perez appeared to believe people were after him. The women went inside, locked the door and called police.
Deputy Steven Carter was the first deputy to encounter Perez in the garage. Carter reported seeing Perez holding a handgun and repeatedly ordered him to put it down. Additional deputies arrived and established positions around the open garage. Deputies alleged that Perez remained seated behind a pool table holding the handgun and communicated very little with them. Deputy Julian Mata, who had crisis-intervention training, spent more than three hours attempting to communicate with Perez and persuade him to put the gun down.
As the barricade continued, deputies evacuated nearby residents and staged medical personnel. The Sheriff’s Department eventually deployed its Specialized Enforcement Division, including crisis negotiators and tactical deputies. Deputy Anthony Alcala, a trained crisis negotiator, continued attempts to establish communication with Perez. Specialized Enforcement Division personnel included Sgt. Lucas Gaytan, Corporals Gregory Gary and Cory McCarthy and Deputies David Moore, Cristina Olivas, Andrew Pollick and Joshua Stone.
After approximately four hours, Perez placed the handgun on the garage floor near the pool table and began walking toward deputies. Police accounts state that Perez stopped in the middle of the garage rather than continuing forward. Sgt. Gaytan ordered him to get onto the ground so deputies could detain and search him. Perez then stepped backward in the direction of the handgun. Deputies Joshua Stone and Gaytan fired less-lethal impact projectiles at Perez.
Police alleged that after the less-lethal rounds struck him, Perez turned and ran approximately 15 feet back toward the handgun. At that point Corporal Cory McCarthy and Deputies David Moore, Cristina Olivas and Andrew Pollick opened fire. Their subsequent accounts differed somewhat in their precise observations: Moore said Perez was three to five feet from the gun when he fired; Olivas estimated two to three feet; Pollick said Perez was still a couple of yards away and facing away from him when he opened fire; McCarthy reported seeing Perez bend down and reach toward the weapon.
The four deputies fired numerous rounds. Moore reported firing five rounds. Olivas fired three. Pollick estimated firing five to eight rounds in an initial volley and another five to eight rounds after Perez disappeared behind the pool table. McCarthy fired multiple volleys from his rifle, including additional rounds after Perez was behind the pool table because McCarthy believed he saw a muzzle flash and thought Perez was shooting at deputies. Pollick similarly reported hearing what he believed were pistol rounds and fired a second volley at Perez’s exposed legs.
No available recording captured the actual fatal shooting. The District Attorney's later review states that belt recordings were examined and that two AXON recordings from a Rialto Police Department K-9 officer were available, but neither video captured the lethal-force encounter. Investigators recovered a loaded Smith & Wesson M&P .45 Shield handgun from the garage. Its serial number had been obliterated.
Deputies provided medical treatment after the shooting and transported Perez to a hospital, where he died. An autopsy documented multiple gunshot wounds involving his head, abdomen, right arm, right thigh and both legs, together with additional ricochet and projectile-fragment injuries. The medical examiner determined that the cause of death was multiple gunshot wounds. Toxicology subsequently detected methamphetamine and amphetamine. The District Attorney's investigation reported that Perez had no known adult criminal history.
The San Bernardino County District Attorney’s Office did not complete its public review until 2024, more than two years after Perez was killed. The office identified all four shooting deputies and concluded that McCarthy, Moore, Olivas and Pollick were legally justified in using deadly force. No criminal charges were filed against them.
Corporal Cory McCarthy had previously killed another person while working for the San Bernardino County Sheriff’s Department. On 11/19/2019, McCarthy fatally shot Jacob Scott Cato during a SWAT barricade in Yucca Valley. The San Bernardino County District Attorney subsequently ruled McCarthy’s killing of Cato legally justified. McCarthy also participated in the tactical response to the September 2020 Joshua Beedie shooting incident in Lucerne Valley.
