OPEN RECORDS SUMMARY :

On June 11, 2024, at approximately 6:40 a.m., South Bend Police Department officers responded to reports of a man threatening individuals with a knife near the East Race and LaSalle Avenue in South Bend, Indiana. The suspect, identified as 69-year-old John Charles Neiswender, had allegedly chased two city workers with a knife after they confronted him for public urination, stabbing their vehicle before fleeing the scene.

Officers Joseph Carey and Randall McMurray located Neiswender in a nearby parking lot at the intersection of East LaSalle Avenue and North Niles Avenue. Upon approach, Neiswender brandished a knife and threatened to kill the officers. Officer McMurray, trained in crisis intervention, attempted to de-escalate the situation and deployed his Taser multiple times. Neiswender then advanced toward the officers with the knife. In response, Officer Carey opened fire, striking Neiswender three times. Neiswender was transported to a local hospital, where he was pronounced dead.

Both officers were placed on administrative leave pending an investigation. The St. Joseph County Prosecutor's Office reviewed the incident and, on June 27, 2024, ruled the shooting justified, stating that Officer Carey acted in self-defense. Body camera footage of the incident was released.
