OPEN RECORDS SUMMARY :
On 08/02/2024 at approximately 7:00 p.m., Elk City police officers responded to a reported disturbance near West 3rd Street and Pioneer Road in the U.S. Highway 66 area of Elk City. Dispatch advised officers that a man was creating a disturbance in the area.
Officers encountered 29-year-old Jerry Garcia holding a knife. Police attempted to speak with Garcia and repeatedly ordered him to drop the knife while maintaining distance and attempting to resolve the encounter. Garcia continued advancing while holding the knife despite repeated commands to disarm.
Police fired their weapons, striking Garcia. Officers rendered medical aid until emergency medical personnel arrived. Garcia was transported to a local hospital, where he was pronounced dead from his injuries.
The Oklahoma State Bureau of Investigation assumed responsibility for the investigation at the request of the Elk City Police Department. OSBI agents processed the scene, interviewed witnesses, collected physical evidence and reviewed officer statements as part of the independent investigation.
The involved officers were placed on routine administrative leave while the investigation proceeded. After the OSBI completed its investigation, the case was submitted to the Beckham County District Attorney for review and charging consideration.
No publicly reported wrongful-death lawsuit or civil settlement related to Garcia's death was located.
