OPEN RECORDS SUMMARY :
On 08/06/2022, at approximately 9:15 p.m., a Lawrence County Sheriff's Office deputy attempted to stop a gold Ford F-150 that was being driven down the center of the roadway near the intersection of County Road 217 and County Road 214 for a traffic violation. Marty Hutto continued driving away, and the deputy pursued the truck. During the pursuit, Hutto threw bottles and nails from the truck, damaging the deputy's windshield and tires.
The pursuit ended on County Road 222 after Hutto's truck became disabled. According to the district attorney's report, Hutto opened the driver's door and pointed what appeared to be a handgun at the deputy. The deputy fired his service weapon, striking Hutto. An ambulance was requested, and Hutto was pronounced dead at the scene. An autopsy determined he died from gunshot wounds to the chest and left arm.
Investigators recovered the weapon beside Hutto. It was determined to be a flare gun that had been painted black and modified to fire a 12-gauge shotgun shell. The Alabama Law Enforcement Agency investigated the shooting and presented its findings to a Lawrence County grand jury.
On 11/18/2022, Lawrence County District Attorney Errek Jett announced that the grand jury concluded the deputy's use of deadly force was legally justified after reviewing the evidence and witness testimony.
