OPEN RECORDS SUMMARY :

On October 18, 2024, Albuquerque police officers were conducting a code enforcement operation at the Tewa Lodge on Central Avenue. During the operation, officers detained 39-year-old Matthew Garcia, who initially provided a false name. After confirming his identity and discovering outstanding felony warrants, officers handcuffed Garcia and placed him in the back of a patrol vehicle without conducting a thorough search. Garcia remained in the vehicle for approximately 45 minutes. When officers attempted to remove him, a struggle ensued as Garcia revealed a concealed firearm. Officers Precious Cadena and Earles discharged their weapons, firing 11 rounds and fatally wounding Garcia. The incident sparked public outcry and led to a wrongful death lawsuit filed by Garcia's estate against the city, alleging negligence and excessive use of force.
