OPEN RECORDS SUMMARY :

On 08/29/2021, at approximately 4:15 a.m., two off-duty New York City Police Department officers who had just completed their shifts at the nearby 46th Precinct encountered a confrontation outside a grocery store at 2080 Valentine Avenue near East 180th Street in the Fordham Heights section of the Bronx. Twenty-four-year-old Michael Rosado and his father, Rafael Rosado, were involved in a dispute with a group of people that escalated into a physical altercation.
According to the NYPD, Michael Rosado allegedly produced a handgun and fired multiple rounds during the dispute. The two off-duty officers heard or observed the gunfire and intervened. Police alleged that Rosado then fired multiple rounds toward the officers. Both officers returned fire, striking Rosado in the torso.
After Rosado was shot and fell, police alleged that his father picked up his son's handgun and fired multiple rounds toward one of the officers. Surveillance video documented portions of the confrontation. Neither off-duty officer was struck by the gunfire. Rafael Rosado was subsequently taken into custody.
The officers provided medical assistance to Michael Rosado after the gunfire ended. Emergency medical personnel transported him to St. Barnabas Hospital, where he was pronounced dead. The New York State Attorney General's Office later confirmed that two off-duty NYPD officers fired at Rosado and that at least one of their shots caused his death.
Because the shooting resulted in a civilian death caused by police, the New York Attorney General's Office of Special Investigation opened an independent investigation. Investigators obtained surveillance recordings from a private business showing portions of the encounter, and Attorney General Letitia James publicly released two of those recordings on 10/01/2021.
The separate criminal case against Rafael Rosado continued after his son's death. On 10/07/2021, a Bronx County grand jury indicted him on first-degree attempted murder and additional charges for allegedly firing at one of the off-duty officers. The Bronx District Attorney's announcement specifically acknowledged that Michael Rosado was fatally shot by police during the same encounter and that the Attorney General's Office was independently investigating his death.
