On 08/18/2025, North Charleston Police Department officers attempted to stop a vehicle driven by 35-year-old Robert Rose, a U.S. Army veteran, after determining the vehicle displayed a license plate that did not belong on it. Officers initiated a traffic stop on Dorchester Road. According to police, Rose initially stopped but then drove away, leading officers on a brief pursuit before stopping again.
Police reported that after the vehicle came to a stop, Rose remained inside for several minutes before getting out. Officers stated he ignored repeated commands and a confrontation followed. During the encounter, at least one officer fired, striking Rose. Officers rendered emergency medical aid until paramedics arrived, but Rose died from his injuries. No officers were reported injured. The South Carolina Law Enforcement Division (SLED) assumed responsibility for the investigation, as required by state law for police shootings.
After reviewing the investigation, Ninth Circuit Solicitor Scarlett Wilson declined to file criminal charges against the officers. Wilson concluded that the evidence supported the officers' claim that they reasonably believed deadly force was necessary under South Carolina's law governing justifiable homicide by law enforcement. The officers were not publicly identified and returned to duty following the investigation.
On 07/31/2026, Rose's family filed a federal civil rights lawsuit against the City of North Charleston, the North Charleston Police Department, and the officers involved in the shooting. The complaint alleges the officers used excessive and unconstitutional deadly force, violated Rose's rights under the Fourth Amendment, and failed to properly de-escalate the encounter. The lawsuit further alleges that the City of North Charleston maintained unconstitutional customs, policies, and practices regarding the use of force, training, supervision, and accountability that contributed to the shooting. The complaint seeks compensatory damages, punitive damages, attorney's fees, and other relief under 42 U.S.C. § 1983, the federal Civil Rights Act, which allows lawsuits against government officials alleged to have violated constitutional rights while acting under color of state law. Rose's father publicly disputed the official account and stated that he believes officers unnecessarily escalated the encounter and failed to handle the situation appropriately. The city had not filed a response to the lawsuit as of the latest reporting.
