OPEN RECORDS SUMMARY :
On May 12, 2024, deputies from the Comal County Sheriff's Office responded to a mental health distress call regarding a suicidal individual at the 1400 block of Elm Creek Road, northwest of New Braunfels. Upon arrival, 68-year-old Claire Janice Roth displayed a handgun and pointed it at the responding officers. A deputy opened fire, striking Roth. She was transported to a hospital, where she died several days later. The Comal County District Attorney's Office recused itself from the investigation, and the case was reviewed by the Hays County District Attorney's Office. On May 22, 2025, a grand jury determined that the deputy's use of force was legally justified, and no criminal charges will be filed.
