OPEN RECORDS SUMMARY :
On April 7, 2025, at approximately 9:00 a.m., San Joaquin County Sheriff's deputies responded to Eastside Community Park in Garden Acres, California, following complaints of illegal dumping. They encountered 41-year-old Gregory Fitzgerald and a female companion near a vehicle with expired registration. Deputies observed what appeared to be a rifle in the vehicle, which the woman identified as a pellet gun.
When deputies attempted to detain Fitzgerald, he fled on foot, leading to a pursuit that culminated in Fitzgerald climbing onto the roof of a residence on East Ardelle Avenue. Over a two-hour standoff, Fitzgerald repeatedly claimed to be armed and threatened to shoot deputies. At approximately 11:14 a.m., Fitzgerald allegedly raised a black object towards deputies.
A SWAT operator and two deputies opened fire, striking Fitzgerald. He was transported to a local hospital, where he was pronounced dead. No firearm was recovered at the scene; the object Fitzgerald pointed was later identified as a non-lethal item.
The California Department of Justice is investigating the incident under Assembly Bill 1506, which mandates state-level review of officer-involved shootings resulting in the death of unarmed individuals.
