OPEN RECORDS SUMMARY :
On 08/23/2023, at approximately 4:49 p.m., Cabarrus County Sheriff’s Office deputies responded to an address on Odell School Road near Poplar Tent Road in Concord after learning that 34-year-old Andrew James Marlow was at the residence and had multiple active felony warrants.

The outstanding warrants included two counts of possession of a stolen firearm, two counts of larceny of a firearm, three counts of felony breaking and/or entering, one count of larceny of a motor vehicle and one count of obtaining property by false pretenses. Because the warrants involved firearms and deputies considered the arrest potentially high risk, the Cabarrus County Sheriff’s Office deployed its Special Response Team.

Special Response Team deputies approached Marlow to take him into custody. According to the Cabarrus County Sheriff’s Office, Marlow displayed a firearm and pointed it toward deputies. Deputies then opened fire on Marlow. The allegation that Marlow pointed the weapon is based on the Sheriff’s Office account of the encounter.

A neighbor reported hearing approximately 15 to 20 gunshots and said police had a drone operating overhead during the tactical response. The available reporting does not establish how many deputies fired or how many rounds each deputy discharged.

Deputies attempted lifesaving measures after the shooting, but Marlow died at the scene.

The North Carolina State Bureau of Investigation assumed responsibility for investigating the fatal shooting. The Cabarrus County Sheriff’s Office also opened a separate internal investigation, and the deputies involved were placed on administrative leave. The Sheriff’s Office stated that the SBI investigation would be forwarded to the District Attorney’s Office for review.
