In July 2025, Kansas City Police Department officers responded to the area of Paseo Boulevard and Emanuel Cleaver II Boulevard after a 911 caller reported that a man had pointed what appeared to be a handgun at a passing ambulance. Officers located 64-year-old Rodney Aubrey sitting at a RideKC bus stop. According to the lawsuit later filed by his family, Aubrey was not behaving suspiciously when officers first observed him, and one officer watched him from approximately a block away until additional officers arrived.
The lawsuit alleges officers Joseph Gennarelli and Jacob Israel drove to the bus stop, exited their patrol vehicles with firearms drawn, and immediately began giving Aubrey multiple commands at the same time. According to the complaint, Aubrey told the officers, "I have a gun," but became confused by the conflicting commands. The lawsuit alleges Aubrey never threatened the officers with the weapon and instead turned and ran down the sidewalk.
After Aubrey began running, the lawsuit states he removed what was later determined to be a replica handgun from his pocket. The family contends body-worn camera and dashboard camera footage shows Aubrey never pointed the replica gun at officers or anyone else after police arrived. Attorney John Picerno, who represents Aubrey's family, stated that he reviewed body-camera footage from all responding officers and dashboard camera video from two patrol vehicles and said the recordings show "100% of the action."
According to the complaint, Officer Joseph Gennarelli fired the first shot from a personally owned patrol rifle, striking Aubrey in the back while he was running away. Officer Jacob Israel then fired two additional rounds before Gennarelli fired again. The lawsuit disputes statements attributed to Gennarelli that Aubrey turned toward officers before the shooting, alleging the available video evidence shows he remained turned away and running when he was shot.
On 07/30/2026, Aubrey's relatives filed a wrongful death lawsuit in Jackson County Circuit Court against Officers Gennarelli and Israel. The complaint alleges the officers used unreasonable and excessive deadly force in violation of Aubrey's constitutional rights and asserts they violated Kansas City Police Department policy by using deadly force against a person who did not present an imminent threat of death or serious physical injury. The lawsuit further alleges the department declined to participate in mediation before litigation was filed. The family seeks damages for wrongful death and requested a jury trial.
Kansas City Police Department declined to comment on the allegations because of the pending litigation. At the time of the latest reporting, no criminal charges against either officer had been announced, and the civil lawsuit remained pending.
