OPEN RECORDS SUMMARY :
Police responded to a 911 call from Montaño’s brother, reporting that Montaño, experiencing a mental health crisis, had a kitchen knife and a utility knife and threatened to kill him and their mother. The brother told dispatch, “He has mental issues,” and said Montaño was blocking their mother’s exit. Officers waited outside the home for less-lethal tools that were not available in their vehicles. When Montaño emerged through the front door holding both knives and moved toward them, officers opened fire within seconds. Montaño, a reserve U.S. Marine with ongoing mental health struggles, died from his injuries. His family and supporters say police should have used non-lethal options and de-escalation tactics instead of deadly force, describing him as someone who needed help, not to be killed. Civil rights attorney John Burris, representing the family, said this was the killing of a military veteran in crisis, not a violent threat.

Officer Nicholas Remick:
Remick was one of the two officers who killed Montaño. In February 2025, Remick and Officer Jessica Khalil fatally shot Jose Mendez-Rios, who they believed was armed but was holding only a knife sheath. The California Department of Justice is investigating that shooting under its protocol for unarmed-involved cases. Remick is also named in at least two federal lawsuits alleging excessive force, including a 2024 incident where he and another officer allegedly assaulted a civilian who was filming a police chase. Attorney John Burris noted that Remick has been involved in two shootings and a beating within a short span.
