The specific traffic violation or other reason Bruner initially stopped Herald has not been publicly disclosed.
.
According to the Indiana State Police investigation, Bruner approached the pickup and spoke with Herald. Police alleged that during the encounter Bruner developed probable cause to arrest Herald, although the initial public releases did not specify what Bruner observed or what offense formed the basis for the planned arrest.
.
Police said that when Bruner attempted to take Herald into custody, Herald resisted and the two became involved in a physical struggle outside the pickup. During the struggle, police alleged that Herald produced a handgun.
.
Indiana State Police reported that Herald fired the handgun and that Bruner then fired his department-issued handgun. Herald was struck by Bruner’s gunfire.
.
Bruner immediately radioed for assistance. Additional deputies and emergency medical personnel responded and attempted to save Herald. Herald was pronounced dead at the scene.
.
Bruner was not struck by gunfire. He was taken to Decatur County Memorial Hospital for evaluation following the physical struggle.
.
The Indiana State Police Versailles Post took responsibility for the criminal investigation at the request of the Decatur County Sheriff’s Office. Investigators documented the scene, collected the firearms and other physical evidence, interviewed witnesses and reviewed available recordings. The completed investigation was forwarded to the Decatur County Prosecutor’s Office for review.
.
The Decatur County Coroner’s Office subsequently identified the man killed as Devin Ray Herald, 34. An autopsy determined that Herald died from multiple gunshot wounds.
.
Deputy Justin Bruner was publicly identified as the Decatur County sheriff’s deputy who shot Herald. Bruner was placed on administrative leave following the shooting in accordance with department procedure.
.
OFFICER BACKGROUND
Justin Bruner was the Decatur County Sheriff’s Office deputy who shot and killed Devin Herald.
.
Bruner was previously involved in another fatal police shooting on 12/16/2022 in Decatur County. Bruner and Decatur County Deputy Jacob Ploeger shot and killed 36-year-old James Richard Davis during an encounter at a residence on East County Road 400 South. Police alleged Davis pointed a handgun at the deputies after officers responded to a domestic disturbance. Indiana State Police investigated that shooting, and Decatur County Prosecutor Nathan Harter subsequently determined that Bruner and Ploeger would not face criminal charges.
