OPEN RECORDS SUMMARY :

On 08/05/2023, at approximately 8:00 p.m., Denver Police Department officers responded to the 2300 block of West Cedar Avenue after receiving a report that Brandon Lee Cole had pushed a woman from her wheelchair and assaulted a 14-year-old child. Officers arrived and found the woman on the ground near her wheelchair. They contacted Cole near a parked vehicle and believed he was holding a knife.
Officers repeatedly ordered Cole to stop. Officer Steven Watson deployed a Taser, but it was ineffective. Cole then turned and rapidly advanced toward Officer Audrey McAndrews while holding what officers believed was a knife. Officer McAndrews fired her service weapon, striking Cole. Officers rendered medical aid, and Cole was transported to a hospital, where he was pronounced dead. Investigators later determined the object in Cole's hand was a black felt marker, not a knife.
The Denver Office of the Medical Examiner identified the decedent as 36-year-old Brandon Lee Cole. The Denver District Attorney reviewed body-camera footage, witness statements, forensic evidence, and the officers' actions. On December 20, 2023, the District Attorney concluded the evidence did not support criminal charges, finding the officers reasonably believed Cole posed an imminent threat of serious bodily injury or death.
