On 07/23/2021, San Diego Police Department officers responded to reports of a shooting and located a vehicle matching the description provided by witnesses near El Cajon Boulevard and 54th Street. Officers attempted to stop the vehicle, but Jesus Salvador Valeta continued driving before stopping and running from the vehicle on foot into the parking lot of a fast-food restaurant.
According to investigators, Valeta tripped while running and dropped a handgun. Police stated that he picked the gun back up and, while on his knees, made a movement with it toward officers. Officers Gregory Bergman and Anthony Guerra fired their service weapons, striking Valeta. Officers rendered aid until paramedics arrived, and Valeta was transported to a hospital, where he later died from his injuries.
The San Diego Police Department released body-worn camera footage of the shooting several days later. The San Diego County Sheriff's Department conducted the criminal investigation under the county's officer-involved shooting protocol, while the San Diego County District Attorney's Office reviewed the officers' use of force. The District Attorney later concluded that the shooting was legally justified under California law and declined to file criminal charges against either officer.
