OPEN RECORDS SUMMARY :
On 08/10/2021, at approximately 9:27 p.m., North Aurora police responded to a residence in the 400 block of Pine Creek Drive after receiving a 911 call reporting that 51-year-old James R. Wiesner was behaving erratically. Officers heard people inside the home but received no response at the door until Wiesner's fiancée arrived and let them enter through the garage. Once inside, Wiesner pointed a handgun at the officers. The officers retreated from the residence into the front yard while Wiesner followed them outside, continuing to hold the handgun. He ignored repeated commands to drop the weapon and continued advancing toward the officers. One officer fired, striking Wiesner in the upper body. Wiesner was pronounced dead at the scene.
The Kane County Major Crimes Task Force Officer-Involved Death Team conducted the investigation. On February 24, 2022, Kane County State's Attorney Jamie Mosser concluded the officer reasonably believed deadly force was necessary to prevent death or great bodily harm after reviewing witness statements, forensic evidence, and the investigative file. She determined the shooting was legally justified and declined criminal charges. The North Aurora Police Department also concluded the officer acted within department policy and returned him to full duty following the investigation.
