OPEN RECORDS SUMMARY :
On 08/11/2021, at approximately 2:35 a.m., a Nebraska State Patrol SWAT trooper shot and killed 35-year-old Brooks Hacker following a four-hour armed standoff at his residence in the 500 block of North Brass Avenue in Juniata. The incident began at approximately 10:15 p.m. on 08/10/2021, when Hacker’s girlfriend called 911 during a physical confrontation and reported that he was intoxicated, firing a handgun and preventing her from leaving. Nebraska State Patrol troopers and Adams County sheriff’s deputies established a perimeter, and the woman escaped approximately 30 minutes later. Adams County Emergency Management issued a shelter-in-place order for nearby residents.
Hacker continued firing from the residence for several hours, striking Nebraska State Patrol and Hastings Police Department vehicles, including armored vehicles. SWAT negotiators attempted to communicate with him throughout the standoff. At approximately 1:35 a.m., Hacker fired toward police and struck a Nebraska State Patrol trooper in the arm. Paramedics treated the trooper before transporting him to Mary Lanning Hospital.
At approximately 2:35 a.m., police deployed tear gas into the residence. Hacker came outside holding a 9mm handgun and firing toward officers. A Nebraska State Patrol SWAT trooper fired one shot, striking and killing him. The subsequent investigation determined that Hacker fired 79 rounds during the incident, including shots directed at his girlfriend, responding officers and police vehicles. Investigators recovered his handgun equipped with a laser sight.
An Adams County grand jury reviewed the death in April 2022. The jury heard two days of testimony from police personnel, a forensic expert and Hacker’s girlfriend and examined a 391-page investigative record. The grand jury concluded that the SWAT trooper’s use of deadly force was legally justified and found no criminal conduct by law enforcement.
