OPEN RECORDS SUMMARY :

On 08/13/2021, at approximately 8:47 a.m., Bakersfield police responded to multiple 911 calls reporting a disturbance at an apartment complex in the 200 block of Stephens Drive. Callers reported yelling between a man and a woman, and neighbors advised that the man, later identified as 35-year-old Alfredo Garcia, appeared to be under the influence of drugs or alcohol. Officers learned that Garcia's mother had previously given a neighbor a bag of knives to keep them away from him because of concerns about his behavior.
For approximately one hour, officers attempted to negotiate with Garcia from outside the apartment while trying to get his mother safely out of the residence. During the standoff, officers heard sounds that led them to believe Garcia was assaulting his mother. Officers forced entry into the apartment and found Garcia actively stabbing his mother with a knife. Three officers fired their service weapons, striking Garcia. Officers immediately rendered medical aid and summoned paramedics, but Garcia died at the scene. His mother survived multiple stab wounds and was transported to a hospital for treatment. Multiple knives were recovered beside Garcia.
The California Department of Justice assumed responsibility for the independent investigation under Assembly Bill 1506 because the shooting resulted in a death. The Kern County District Attorney's Office also completed an officer-involved shooting review and released a public memorandum concluding the officers' use of deadly force was legally justified. The review examined body-worn camera recordings, witness interviews, dispatch recordings, forensic evidence, crime scene documentation, and autopsy findings before determining that criminal charges against the officers were not warranted.
