OPEN RECORDS SUMMARY :
On 12/26/2021, Titusville Police responded shortly after 7 p.m. to a 911 report of a woman being assaulted on the roadway in the 1500 block of Gayle Avenue. An officer arrived and approached James Lowery in the roadway and attempted to detain him. Lowery moved away on foot and a physical struggle occurred between him and the officer on the roadway. The officer fired his weapon and struck Lowery, killing him. Authorities later determined officers misidentified Lowery during the response. Internal review concluded the shooting violated policy and prosecutors charged the officer with manslaughter, resulting in a probation sentence.
