OPEN RECORDS SUMMARY :

On 11/19/2022, officers from the Town of Niagara Police Department responded to a 911 domestic disturbance call placed by Daniel Kachinoski and his mother at their residence on Chester Avenue in the Town of Niagara. Upon arrival, officers spoke separately to Mr. Kachinoski and his mother. Mr. Kachinoski became agitated, ignored repeated commands, and refused to comply with officers’ instructions. Officers attempted to use Tasers, which had no effect. Mr. Kachinoski picked up a chair and later a knife and advanced toward an officer with the knife raised. At that point, a Town of Niagara officer fired his service weapon and struck Mr. Kachinoski. Emergency medical responders arrived and Mr. Kachinoski was pronounced dead at the scene from multiple gunshot wounds. The New York State Attorney General’s Office of Special Investigation reviewed the case and concluded that a prosecutor would not be able to disprove beyond a reasonable doubt that the officer’s use of deadly force was justified under New York law. A knife was recovered at the scene.
