OPEN RECORDS SUMMARY :

On 04/17/2025, Wayne County Sheriff's Office deputies attempted to stop a vehicle driven by 29-year-old Devon Allen for traffic violations. During the stop, deputies attempted to verify Allen's identity and directed him to exit the vehicle. Instead, Allen accelerated while a deputy was holding onto the driver's door, dragging the deputy as the vehicle sped away.
According to the New York Attorney General's Office of Special Investigation, the deputy repeatedly yelled for Allen to stop while being dragged alongside the vehicle. The deputy attempted to reach the brake pedal but was unable to stop the vehicle. Investigators concluded Allen also attempted to grab the deputy's service weapon while the deputy was being dragged. The deputy fired one round, striking Allen. The vehicle then came to a stop, and Allen was transported to a hospital, where he was pronounced dead.
The Office of Special Investigation conducted an independent investigation that included body-worn camera footage, scene evidence, witness interviews, forensic testing, dispatch recordings, and a legal review of New York's justification statute. Investigators concluded the deputy reasonably believed deadly physical force was necessary to defend himself while being dragged by the moving vehicle and while Allen allegedly attempted to seize his firearm.
On 07/31/2026, Attorney General Letitia James' Office of Special Investigation released its final investigative report. The report concluded that prosecutors would not be able to disprove beyond a reasonable doubt that the deputy's use of deadly physical force was justified under New York law. Accordingly, the Attorney General's Office declined to present criminal charges against the deputy.
The Attorney General also released body-worn camera footage and the complete investigative report. The report contains a detailed reconstruction of the incident, forensic evidence, diagrams, witness statements, and the legal analysis supporting the decision not to pursue criminal charges. As of the report's release, the deputy's name had not been publicly disclosed in the Attorney General's report.
