OPEN RECORDS SUMMARY :

On 03/14/2021, Allen Police Department officers encountered Marvin David Scott III, 26, at Allen Premium Outlets. Police arrested Scott for possession of less than two ounces of marijuana. Because Scott was exhibiting concerning behavior, officers first transported him to Texas Health Presbyterian Hospital Allen, where he remained in the emergency department for approximately three hours. After the hospital released him, Allen police transported him to the Collin County Detention Facility in McKinney.

Scott arrived at the jail at approximately 6:22 p.m. During booking, detention personnel encountered Scott while he was experiencing a mental health crisis. Collin County Sheriff Jim Skinner later confirmed that personnel used pepper spray, placed a spit hood over Scott's head and attempted to secure him to a restraint bed.

During the restraint, Scott became unresponsive at approximately 10:22 p.m. Jail personnel provided medical aid and Scott was transported to a hospital, where he was pronounced dead. Video of the fatal restraint existed and was reviewed during the subsequent investigation.

Collin County Medical Examiner Dr. William Rohr determined that Scott died from "fatal acute stress response in an individual with previously diagnosed schizophrenia during restraint struggle with law enforcement." The manner of death was Homicide.

Seven Collin County detention officers were initially fired after an internal investigation found violations of Sheriff's Office policies and procedures. An eighth detention officer resigned while under investigation. The personnel involved were not publicly identified in the contemporary reporting. A Collin County grand jury later declined to indict the detention officers.

The Collin County detention personnel involved in Scott's fatal restraint were not publicly identified. Seven were fired following the Sheriff's Office administrative investigation and an eighth resigned.
