Laurel PD set up a “safe checkpoint” and stopped 18-year-old Dakota Gray. Police felt they smelled marijuana and the driver fled with police chasing the vehicle at high speeds until it crashed into a tree, killing Dakota Gray. Police allege that they called off the chase just before impact, a very common police action when a fatal crash is likely. During a chase, a person is considered “in custody” with the PD bearing responsibility for the chase. If a crash is imminent at high speeds and the chase is “called off” moments prior, it is just an accident and no longer the result of a pursuit.
