Originally, police claimed that Stephen Poolson Jr., 41, then produced a gun, at which point the responding officer shot him. Poolson died later at the hospital. Police had claimed he crashed on his own and died in the crash and had to correct this to Poolson having been deliberately hit by a patrol car and being shot when he ran. The partner, a local business woman, hired attorney Marhoffer who said that Leoni had no prior criminal record, history of violence of “anything in his past that would lead to the conclusion that this was a necessary event that occurred in that house that night.”
