A citizen had reported seeing a handgun in Méndez Berry's waistband. Deputies located him in the 6300 block of Cherrywood Drive in the Town of Fond du Lac. After Méndez Berry allegedly refused to follow repeated commands, a deputy discharged a non-lethal weapon. Méndez Berry then produced what deputies believed to be a firearm, prompting another deputy to discharge their firearm at 6:22 p.m., striking him. Life-saving measures were attempted, and Méndez Berry was transported to a nearby hospital, where he was pronounced dead.
